Which is about an adjustment of status obtained via an F4 petition, not the DV application which had been denied.

correction. DV application was not processed in time by uscis which is no fault of the applicant as he submitted all necessary documents eight months before end of fiscal year.

so sad that when people are trying to console others who have been inconvenienced by the system that there are people here who are countering their good deeds. no wonder there is so much hate and spite in this world. I feel for this guy he was selected for a once in a lifetime chance and it was snatched from him by inconsiderate humans. :cry:

The article suggested the person eventually gotten his Green Card through Family-Based Visa (F4 sibling visa), not through DV lottery :rolleyes:

Thank you. The article indeed confirms that no DV based visas can be issued after the end of the relevant fiscal year, which is what the law and the DV instructions state unequivocally.

And has been mentioned before - and many consulate websites specifically state this fact - there is no appeal for consular processing of DV. The person in the case was doing AOS. So it's not a relevant precedent.

Finally, OP was consulting a lawyer anyway.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
