Last week my husband and I received an RFE saying the copy of his birth certificate was insufficient. And that we should submit further evidence like hospital records with his parents signature. We are really confused because we submitted the original birth certificate that in Nigeria this is the same birth certificate that he showed at his interview. We are just very confused because this birth certificate comes from Nigeria government and it has an official seal and stamp. We also have a couple of friends that have the same birth certificate and they never received RFE. How can we submit further evidence on something like proof of a birth. Has anyone experience this? Please leave advice as well thanks.

When was his birth certificate issued? In some cases of late registration/issue, USCIS asks for secodary evidences.

It was issued a couple of months before his interview through Nigeria government. ppl in Nigeria do it this because when he was born they did not issue birth certificate that's even what it says on his. Yet they said it's insufficient. We have an appointment at uscis next week hopefully they can help us.

That's the exact reason why they said that's not sufficient. You can provide Affidavits of Birth from your both parents as second proof.

Let's be clear about USCIS's documentary requirements.



USCIS standard is the long-form birth certificate issued by the National Population Commission. However, for a number of reasons, many applicants can't meet that standard.



For instance, applicants who were born before 1992 can't be issued an NPC birth certificate (the NPC can only issue birth certificates for people born after 1992). Such applicants can obtain an attestation of birth from the NPC but that attestation doesn't on its own meet the documentary standards of USCIS. That's probably why you received the RFE. You must also submit, along with the attestation, other supporting evidence of you date of birth, including:


  • A declaration of age (affidavit) sworn in a high court by a relative, preferably the applicant's mother, who would have been old enough to have witnessed the birth
  • A baptismal certificate
  • Hospital records for the time of birth, etc.

What you have more likely reads "Attestation of Birth". It's not a long-form birth certificate, and won't stand on its own. Have a relative older than you swear a declaration of age and attach it to your attestation.

Please I need help, I don't know if anyone have had RFIE for Nigeria birth certificate.



I submitted NPC attestation of birth documents and Declaration of age documents, but I still got RFIE.



Any useful suggestion will be good
