I posted this the other day and need just a little more clarification. I asked if I could fill out the paperwork for Omer, (156, 156K and DS230, and sign the box- filled out by whom?)

The problem is, I am working with a translator (via e-mail in Turkey) to do all of this. So technically, my signature implies that I solely did this.

Do you think we should include both names- (small problem- it will not be possible for him to sign the forms) Or do you think we could attach one of the sample "I am competent in English and Turkish and assisted with the translation of these forms...)

We've come so far so fast, I just don't want to mess this up.

Thanks so much,

Christine

Christine,

You can fill out the form for Omer. In box "filled out by whom?", sign your name. Scan the documents in the highest possible resolution and email to him, mail it, Fed Ex it..... By the way, why are you working with a translator? How do you communicate with your fiance? As for me, I filled out the english version of the forms, signed it, and then emailed them to my fiancee. Also we did the translations for the other documents together while chatting. I signed this also "electronically". To denote they were certified I put a statement at the end. The statement was...

I certify that I am competent to translate from Arabic and/or French to English and that the above is a correct and true translation to the best of my knowledge and belief.

Signed: Myles D. Smith (electronically signed) and ____________________

Good luck. Sorry for Omer loss. I know what it feels like to lose a parent. If I were you I would not try to post-pone the interview. I think he has at least a month and a half before his appointment. Then he has possible administrative processing (he he does not). Also he has 6 months to use this visa to come to the USA. Wish you luck.

Yusuf

I think I was late filing for AOS:

07/27/07: Mailed AOS papers to Chicago mailbox.

08/02/07: AOS papers received in Chicago.

I would be so careful about doing anything that even "appears" like you misrepresented your case. It might come back to haunt you.....and although, yes, it will cause a delay if that person who aided you with the translation has to sign (cause I would think you'd have to mail the form to the translator...then back....which could take about 2 weeks considering you're from Turkey), ......regardless, I think it'd be worth taking the extra time to do so, and mail it to the translator, to be safe.

The parts that you are referring to, are similar on both forms (although the DS-230 part 2, doesn't ask for you to sign.....just to list your name and relationship to the beneficiary). On the DS-230, for the I-130 for my wife, I entered my name on the part that asks if anyone assisted, and my relationship as "husband of beneficiary" and didn't have to sign.

But, if it is obvious to the embassy, that your spouse needs a translator, and then they see that you do not speak Turkish well enough to do the translating, I'd be worried about them questioning you more, and then it might have to come out that you used a translator to help you fill out the forms. That might then raise questions as to why you omitted mentioning that person's name on the form.

Also, if you use that form which said "you are competent in English and Turkish...etc..."...and you actually "don't" speak much Turkish...........aren't you worried that they may decide to "test" that somehow and might eventually find that out? (Either at the Embassy and or maybe down the road ?)

The way I look at it.....I would not want to do anything that might delay my case, or worse yet , give them any cause for a denial.

Were it me.....I would not take the chance of leaving anything out. I would probably send it to Turkey the fastest method possible, and then have it sent back. (Takes 4-5 days approx to get there.....and 4-5 days to get back....depending on how you send it)

I just feel if you omit ANYTHING....you are playing with fire.

After writing all that........

I looked at the form for the K-1 again. It just says "application prepared by".....

It doesn't really ask for "everyone" involed (meaning the translator). It just asks for who prepared the form......and has room for "one" signature.

The DS-230 part 2 appears nearly the same, and in either case....doesn't have to have a signature.......(you could consider entering the name.........but won't need a signature)

So, that first response from "MDSMIF" seems more accurate. You most likely don't even need the signature of the translator.

Thanks so much for the suggestions. Just a few clarifications- I live in Philadelphia, Omer lives in Istanbul. I have only been taking weekly Turkish classes for 7 mos. So- I don't speak Turkish. Omer speaks enough English for us to talk every night on the phone- but it is far from very good.

I agree- at the interview it will be obvious I don't speak Turkish and that his English is so/so- . So, to have succint clear forms in English might raise a question.

I was suggesting that our mutual friend who translates all of our very long e-mails, write a letter saying he is competent in English and Turkish and aided with the forms. My concern is that he would be writing this letter , signing etc...and then mailing it to Omer, but his signature wouldn't be on the forms.

I guess to be safe- I shall mail Necdet the papers (our friend), and then he shall DHL them to Omer once he signs.

About postponing the interview- I am not comin to Turkey until the 22 or 23 of June, and staying until the 26 of August. I fear we will get scheduled before that date, and I think it will be really helpful if we are together.

Thanks so much,

Christine

PS- do either of you know if the "Security Clearance" refers to the 157 or something else?

After all of that :)

I have to reopen and look- they are on my laptop, not this computer.

Everything will be so simple if that is the case. I will simply have Necdet draft a letter that he assited and is competent and we will include it with the package.

After all of that :)

Sorry to give you the heart attack. ;)

P.s....No, unfortunately, don't know the answer to the second question. A lot of the things needed for the K-1, were not necessary for the I-130.
