I read through the adjustment of status for K-1. It seems pretty straight forward. After we get married, We can apply. The only questions is can she apply for work right away. What is here status after we get married? I heard adjustment of status can take a long time.

She needs a Employment Authorization Document (EAD I-765) to be able to work legally.

EAD based on K-1:

  • $380
  • Valid only until your I-94 expires
  • Non-renewable

EAD based on AOS:

  • Fee waived
  • Valid for one year after issue
  • Renewable
  • take about 60-90 days to process

She will be able to work legally once she has EAD and in the process for waiting for AOS (Green Card approval).

Once she has the Green Card, she does not need the EAD anymore.

Once her I-94 expires, she is "out-of-status"

When the AOS has been accepted and the NOA1 been issued, USCIS considers a person with a pending adjustment of status application to be in a period of authorized stay as granted by the Attorney General.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

We just got married!!! She received a social security card and says valid for work only only with DHS authorization. We will be applying for I-485 very soon to get things started. How long will the I765 take to be approved. Her not working is hard financially. Thanks for your responses.
