Fiance in the US - Firstname and Middle Name switched on Visa

I posted this in the general forum but didn't get much help so I come here hoping some of you have gone to the same issue. My fiance has been in the US for three weeks. We got married (with the correct name). When we tried to apply for a SSN, we found out that the firstname and middlename got switched in the Visa and I-94. I contacted Customs & Border Protection in Los Angeles and they told me that they can't fix this problem since the name on the I-94 matched the name on the Visa. The guy I talked to told me that this is a common "Vietnamese" problem and told me that I and my fiance need to contact the US Embassy in Tijuana and get an appointment, and they will fix it for us. I asked if my fiance can get out of the US and come back and they told me yes.

This is wild. What solution do I have other than calling the US embassy in Tijuana?

OK, I googled this website and found out that my fiance can't travel outside the country during this time because it is considered self-deportation. I emailed the embassy in HCM in Vietnam and the National Visa Center to ask about this case. I will let you know what happen.

In the meantime, please give me some suggestions on how to resolve this case.

During POE, they enter my wife's name as Middle, First, Last in the I-94. When we went to apply for SSN, they told us we have to wait for green card for us to be able to use her married name but what she could do is apply under whatever's on the I-94 and then come back to change it when she gets her green card. But we never waited for the green card, instead we came back once she got her SSN with our marriage Certificate, and they were able to change her name to her married name.

Americans aren't as freaky about name order as the Asian countries. Don't sweat it. My Vietnamese wife has her name butchered often - not a problem. It's the SE Asian side of the globe that is intolerant of anything out of order. Which is funny, given the fact that they can't stand in line or drive with any semblance of modern social life.

Here is the response from the HCMC Embassy:

Dear Sir/Madam,

Thank you for your inquiry.

If the beneficiary’s [Vietnamese] passport shows the full name as: “Nguyen Thi Thanh Thao”, the beneficiary’s visa will show “Nguyen” as Surname and “Thi Thanh Thao” as Given name. As this is the correct order as listed in the U.S. Department of State systems, no adjustments can be made.

If you have further questions, please do not reply to this email. Instead, please submit your inquiry to:http://hochiminh.usconsulate.gov/contact/ivinquiries.html. Unfortunately, we are unable to respond to inquiries sent directly to this email address.

Sincerely,

Information and Public Outreach Team - 1

Consular Section

U.S. Consulate General in HCMC

http://hochiminh.usconsulate.gov

My fiance middle name is "Thi" and first name is "Thanh Thao". This is strange, since the Given Name should be Firstname + Middlename. The person who responded seems to indicate Given name as "Middle Name + First Name".

Anyway, I will go through with the paperworks with this name and hopefully, make adjustments as needed when we see apply for the greencard.

Thanks,

John

Don't worry too much about it John, I applied for AOS with my wife's married name and also changed her SSN to her married name without an issue. Her EAD/AP combo card is also in her married name.

K-1 visa is one time use only. It is expired after you entered us. US Embassy in Tijuana is wrong regarding this matter. You cannot get out US until you have your green card

I was exactly in your shoes. My fiance name is Pham Thi Ngoc. So her middle name become first name. I went to SSN office they take the THI (Middle name) is her first name which I dont want. So I contacted the Customes & Border Protection at Colorado and they fixed it right away for us and updated their system in 5 minutes. So we just went online and printed out the new I94 and correct our SSN. Try to contact Customs and Border in person and explain to them your situation and they will help you out.

PS I just applied for AOS last week and very exited to see how it go (but I am worry I will get an RFE because I dont have DS3025 for vaccination. I just provided them a copy of yellow paper vaccination record so I dont know if they can take it or not. Will see. Good luck with your Journey)

Hi Ken, yellow paper vaccination and DS-3250 are two different documents?

I thougth they are the same one.

Can you share how you guys do vaccination and medical exam?

I heard that we should make medical exam at IOM coz they dont require vaccination sheet prior to make medical examination.

Also, how long it takes to receive the result after you have all checked?

Hi,

For medical exam, you have to schedule with IOM and the the result you might get in the same day or one day later. I suggest that you do the Vaccination first and then bring that yellow paper to IOM so they can translate to DS3250 or even I693 so you don't have to worry about that later. Just make sure ask them for a copy for DS3250 or I693 so that you can use to apply for AOS

Wow sounds good!

Also, vaccination could also get done in one day? Or can i make vaccination appointment in the morning, wait to take the yellow sheet and come to IOM in the afternoon same day?

Coz i live in Danang and still working, so I need to make sure to give myself plentty of time to get things done perfectly.

I don't know if you have enough time to do everything in the same day. But just try it. For the vaccination, I recommend that you do it as soon as you can before you schedule for IOM medical as long as you have your NVC case number. Vaccination has to do 2 times and within 1-2 weeks in order to complete all the require shots. If you don't have time to do so, you can take that yellow paper to IOM and they also help you transfer to I693 but you have to complete other shots in the US before you apply for green card/AOS. That all I know. Good luck

hi Ken88,

Im about to submit change of status for my wife and a bit confuse about form I-693.

Before my wife went to the interview in HCM. She only did her medical exam but no vacination. When she received her visa and the sealed package, there no mention about vaccination in the US.

What do i need to do to get the vaccine so i can file for green card

i found more information on uscis website.

Since the medical exam in vietnam is still within 1 year i do not need to do the exam again, I just need the Vaccine correct?

Anyone got this done before could you please tell me how much it normally run? I called couple doctor office in my area provided by USCIS website they quote me anywhere from 700 - 1000 that include vaccine and exam.
