Is I865 necessary?

Hello everyone. Hope all of you are going great today.

I just was wondering if I865 is an important part in removing conditions process. We have moved twice in the past 2 years. I submitted AR 11 both times. But literally just found out about i865. We are starting ROC in July this year, should I go and mail my husband's change of the adress before ROC? My husband is confused why they need it,if we have evidence showing we live together. I want to mail it just to be safe.

I wouldn't. Others have just sent it in late without issue.

It's not recommended, but you can hardly go back into the past and change it now.

Is this also applicable for a sponsor of AOS stage? When we filed for my AOS from K1, we were at another address and we moved after a month of that. I submitted AR11 but my husband didn't submit i-865. I have interview in a week for AOS. Should we submit it now or take it with us to the interview?

No you don't have a green card yet.

Bring a new I-864 to interview. And next time please post your own questions on your own threads in the correct forums. Thank you! ;)

Filed: Timeline

The instructions for the I-865 form clearly state that the sponsor has to notify USCIS of the address change within 30 days of moving. It is independent of removing conditions. It's simply an information for the U.S. government that the person who sponsored you during your AOS is now living in a new address. So even if you duly submitted your AR-11 and your husband/sponsor also lives with you in the same address, he still has to do his part and submit Form I-865.

Thanks so much for the clear advice. I just submitted this form for a move 3 months ago. I put my actual move date, so it would align with my wife's AR-11 date, and the date on her 751-G.

And although get why they want to know my address, it makes me uneasy to report to the USG when I move. Part of the sacrifice for electing to go through this visa journey, but creepy nonetheless.

You have to tell them when you move anyhow when you do taxes, when you update your w4, when you update your insurance, before you can update your vehicle registration... You need to update your bank and credit cards when you move... It's a hassle to update everything, yes, but you need to do it anyhow. I'm unsure how one more form because of immigration is that big of a deal.

Your ROC won't be denied or RFE'd because of not sending in the I-865 however. My husband WORKS for the FAA and refused to send in the I-865 when I gave it to him. It's his job, I'm not doing it for him and I correctly submitted my AR-11 online. However, my ROC was still approved without RFE or interview. I used our title to the house as part of my evidence since it has both of our names on it too. Pretty sure since they pay his wage they know where he is, but still. He likes the privacy and hates how non-private the world has become.

Exactly. Not much privacy in the immigration process. As long as you have an I-864 and are on the hook for sponsoring someone, they want to know where you are.

Too bad they can't change the name of the form. I-865 (change of address for sponsor) is so similar to I-864 (affidavit of support) that I think people confuse them.
