Highly sensitive topic and heavily discussed here on VJ. I think for the most part a lot of immigrants are ignorant to the fact that it is fraud.

I mean USCIS does an excellent job at confusing the heck out of you... I am a USC having this battle, and I have a Graduate Degree, and I specialize in Social Work, being a a problem solver is what I do. Help People. Guide them through the complicated and rigorous processes our government railroads us into... I can only imagine the nightmare for every day people with no clue!

Someone fro USCIS told her husband he can travel to the US on a tourist visa and stay and complete the immigration process.

Resulted in her husband spending a night in detainment, sent back to his country, and having his tourist visa cancelled.

Wish there was a better way to inform immigrants that doing this is a no-no.

OP, this is straying off topic. You can file immigrant visas for the 2 youngest step kids. You start by filing I-130 alone for each. This process will be different than what you did for your husband and it will never involve a I-485.

The I-130 will be approved, then you will do stuff with the National Visa Center, then the file will be sent to Jordan and they will have their interviews and get immigrant visas. They will fly to the US and become permanent residents when they land.

You will have to sort out custody arrangements and get permission from the mom to let them move.

OK, so do we know aprox how long the process takes for Amman, Jordan? I have divorce decree and our marriage license. Do we need like an affidavit of the mom releasing the 15yr old? the two twins are 18 already (boys). my step daughter is 21. From start to finish... you think more than a year?

About a year if there are no complications. Though I am not sure it will be smooth since your stateside case is pending and complicated. Your I-130 from your husband is still not approved which suggests they may suspect the validity of the marriage - no offense meant, but that is protocol since it's his 2nd marriage to USC. That might affect the kids visas, but it may not. I am not sure of this and don't want to scare you - but it might be a possibility.

YOU HAVE BEEN SO GREAT IN HELPING ME!!!!

UPDATES:

  • 5-23-16 My husband received his SS Card within one week of application
  • 6-24-16 He was issued am AZ Drivers License without a problem
  • 8-23-16 Started working at Walmart
  • 6-29-16 Filed his 2015 Tax Return electronically through HR Block and file got flagged for verification since SS did not update databas (takes a year!).
  • 7-23-16 Mailed documents requested by IRS via mail to verify identity (since SSN is new) - Have not heard any updates as of 10-28-16
  • 11-7-16 Planning on filing the I-130 petitions for my step-children overseas.

So for sure I who should I file for? on the USCIS website it says a USC can file a petition for a non-married child under 21.

  1. All Step-Children are over-seas
  2. One Male is born 2000 (Age 13 at time of Marriage)
  3. Two Males born 1998 - Twins (Age 15 at time of Marriage)
  4. One Female born 1995 (Age 18 at the time of Marriage)

the oldest you can't file for her because she has to be under 18 at the time of your marriage to her father

now, your husband can file for her as a LPR

are the children with their mom? will she sign the authorization to come to the US to live with you?

1 is 16, 2 are 18. You can file for them. The other daughter must be filed for with by her LPR parent.

The 16 year old will need consent from the mom to move.

I see.. the oldes DOB 04-04-1995 turned 18 a few months before we got married in AZ through the civil court. Do you think it would count her dad and I were married in July of 2012 through the Islamic Mosque in San Antonio?

You can file for the younger ones, takes about a year.

Oldest one he files for, say 7 years.
