Leaving USA on VWP

Started a new thread before I get accused of hijacking a thread!

A question arose from a different discussion in relation to overstaying on a tourist visa.

I have been back and forth to the USA on countless ocassions and just wanted to clarify something.

Having been here a few years back on vwp which I believe gives me 90 days to return to my home country. When we arrived we told the officer at the POE we were here for a 4 week visit to see friends and family. During the trip my wife became ill (required hospital treatment). The Drs wouldn't let her fly out on our intended departure date so we rescheduled for a couple of weeks later instead.

It's still well within the 90 days but after the date we told the border officer when we would be returning home.

Is this a non issue?

unless he stamped that 'leave by' date in your passport or updated the electronic i94 on when to leave, then you are good as long as you did not leave after the 90 days!!! it he wrote it in the computer and next time you enter he asks 'why did you say you would leave this day but you didnt' then you can say why.. but i highly highly doubt that will come up!

You're good to stay for 90 days on the VWP. Lots of people on the VWP change their return date after entering the US. It's a non-issue.

March 28th 2015 - Choice of agent complete & AOS fee paid


April 17th 2015 - IV fee paid


May 1st 2015 - Sent in IV application


May 12th 2015 - Sent in AOS and IV documents


May 18th 2015 - Scan Date


June 18th 2015 - Checklist received


June 22nd 2015 - Checklist response sent to NVC


June 25th 2015 - Put for Supervisor Review


Sept 15th 2015 - Request help from Texas US Senator Cornyn and his team


Sept 23rd 2015 - Our case is moved from supervisor review to NVC's team for dealing with Senator requests


Nov 4th 2015 - CASE COMPLETE!!!! :dancing:



Embassy Stage


Dec 16th 2015 - Medical exam


Dec 21st 2015 - Interview


Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license

You applied for AOS so you are not on the VWP anymore.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You applied for AOS so you are not on the VWP anymore.

i think the OP was worried that they would look back on a previous visit and say 'you told us 2 visits before you were going to leave after 4 weeks and it shows here you stayed for 8 weeks' and deny them a greencard

Thank you all for your contributions. Maybe was just my mind over analysing reading other posts, as I have been back to the US a few times since then. It just never occurred to me before as we regularly have month long stays and just leave as normal. This time round it's a totally different ball game! Had to really try and get up to speed on immigration policies!

While I was dating my husband I flew out from the UK to the USA and would change my return dates sometimes. It was never an issue. I stayed once for 2 weeks, then twice I extended my stay to 90 days.
