Forgot Letter of Intent

Hi all,

My fiancé (the petitioner) sent off all our paperwork last week to start the K1 process. He told me today he forgot to send his letter of intent to marry along with it. What do we do?

You will get an RFE. There needs to be one from the petitioner and one from the beneficiary.

When they send the RFE, send them in!

You won't receive an RFE until they begin adjudicating your case and see that it is missing.

If you look at the form, he declares his intent when he signs the petition application.

By looking at all the timelines... I would guesstimate 60 to 90 days.

You should get at least NOA1 within a week normally. It has been known for a few days now that CSC is facing delays, I sincerely hope that you get at least NOA1 soon. The wait for NOA2 will be a while longer, unfortunately.

Nich-Nick, I still got an RFE for this exact reason even though we signed the form. They'll likely still get the RFE.

yeah it isnt a huge deal just the wait is a bit longer now:/ maybe another 90 days.

you will get the NOA1 to say they received your applicaiton and then once they look at your paperwork they will see that is missing, send you an RFE with 90 days to respond, have it ready to mail out ASAP and then it will be another 90 days after you mail it in for them to look at it and approve...

so it just delays the aplicaitona about 3 months.. but you will get the K1 visa in the end and everything will work out:)

We got an RFE for the exact same thing. We forgot my fiance's (beneficiary) letter, but I had sent mine. You can check my timeline for timeframes. It took us 3.5 months to get NOA2 from the day we applied. He sent your letter right? Signed by you (not a scan).

It's not the same then. In OP's case the petitioner forgot the send their letter. In your case, the beneficiary forgot his letter.

Difference is that the petitioner signs a statement that he/she is willing and able to marry the beneficiary when he/she signs the I-129f. The beneficiary does not sign such a statement, so if the beneficiary forgets his letter of intent it's a little different.

Yeah, I'm the beneficiary. My fiancé (petitioner) didn't send his letter. We still haven't got the first NOA either, but I know there's a lot of weather issues and delays and stuff. We had to send ours to the Texas lockbox. My letter (signed by me) is included in what's been sent off.
