K1 Filed but have changed mind

Hi all,

My fiance and I have filed for our K1 visa but have only gotten as far as the NOA1 step.

I am currently visiting him from the UK on an ESTA and our circumstances have changed, we would like me to stay here.

Is it possible to cancel the K1 and go straight ahead and get married, before filing for AOS?

You can marry and adjust status without going home, yes- as long as you are currently in the US. Edited by FN&KO

11/27/2015- Arrived at Embassy
06/2016- Third visit to Nigeria!
06/15/2016- Interview, given option to file I-601 waiver.
08/16/2016- Waiver submitted (no lawyer).
11/21/2016- Waiver approved with expedite.
01/2017- Embassy requested interview. 
04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

You should write to USCIS and let them know you're withdrawing your application.

Doubt you can just stay there. You should research what it takes for you to stay in the UK, visa's etc.

Lol, ignore what I just said. Don't know how I could read your first post so completely wrong.

Just be aware that you might have a tougher time later on AOS or ROC because you are adjusting from ESTA since that's technically not the right way of doing it. It's not fraud since you realized after coming here you wanted to go that route but they might question it so just be prepared for that.

IF you're already in the U.S. THEN

pull the K-1 petition, get married and AOS; /* B-1, F-1, ESTA AOSs de facto may attract more scrutiny and may take longer */

ELSE IF you are still in the UK and are planning to fly to the U.S. to get married

You will be committing visa fraud and risk serious consequences;
