Different name on NSO birth certificate?

My parents weren't married yet when they had me so my last name on NSO is my mother's last name. But, my name on the city hall is my father's last name. We just noticed now since this is the first time I needed to use the NSO birth certificate. We're fixing it now but they said it might take 2-3 months or more. My question is, could we use only the birth certificate from the city hall for passport? I'm not sure we can wait for 2 or more months since we got the NOA1 last March 8 (for k1 visa).

06/25/2015 - Priority Date

06/29/2015 - Received a text from USCIS case is received

07/25/2015 - Received NOA1

11/04/2015 - I-130 approved

11/09/2015 - Received NOA2

12/16/2015 - Case sent to Dept of State

12/21/2015 - NVC received my case for visa processing

01/09/2016 - NVC Welcome Letter Received

01/09/2016 - Paid AOS fee and selected agent

01/13/2016 - Reviewed DS-261 over the phone

01/14/2016 - Recieved invoice for IV fee

01/15/2016 - Paid IV fee

01/19/2016 - Mailed financial/supporting documents to NVC

01/20/2016 - Submitted DS-260

01/22/2016 - Email notification from NVC that they received the financial/supporting documents

02/29/2016 - Email checklist from NVC

03/09/2016 - Responded to NVC checklist (mailed)

03/15/2016 - Additional document received by NVC (another 30-45 days wait...ugh!!!!)

04/12/2016 - Case complete...waiting for interview/medical schedule

04/14/2016 - Received email for Mom's interview schedule, 26th of May

04/24/2016 - Registered Online for upcoming Medical exam appointment, May 11, 2016

05/11/2016 - Medical exam. Passed

05/26/2016 - Interview. Under administrative review.

06/09/2016 - Visa Issued

06/15/2016 - Received text notification from 2go for visa delivery

06/17/2016 - Visa received on hand

06/28/2016 - PDOS seminar

07/17/2016 - Mom's flight to USA ???

You will get an annotated BC of your legitimization due to subsequent marriage of your parents with your father's family name.

It depends on where are you from and how fast LRC will forward your request to PSA/ NSO main. True that could be around 2-3 months. You can try to work in parallel by filling with PSA main after one week that LRC sent your docs. Still your docs will not be there at PSA, bring all your related docs so they can accept your request. You cannot do everything in one trip and they may ask you to come back. There are people that can help you in PSA with a fee of course. You can only help fast track if you go to PSA main. Otherwise, sit and relax the wait is 2-3 months or longer.

DFA only accepts BC as follows:

1. Birth Certificate (BC) in Security Paper (SECPA) issued by the Philippine Statistics Authority(PSA)

2. Certified True Copy (CTC) of BC issued by the Local Civil Registrar (LCR) and duly authenticated by PSA. Transcribed Birth Certificate from the LCR is required when entries in PSA Birth Certificate are blurred or unreadable

You can try the 2nd option, check your local PSA office for the process. This can be faster.

But take note the US Embassy Manila only accepts BC form PSA/ NSO.

March 3- Interview, approved on the Spot

March 8 - received GC

We had the same problem. DFA wouldn't give my fiancé a passport until she got her last name corrected. Her parents split a long time ago and they called her different last names through the years. It did her a disservice and cost me a lot of money and aggravation. After 4.5 months she finally gets a passport with 30 days left before her Visa expires! The good news is that once you get a passport things go quickly after you get a case number assigned.
