Hello guys. I applied for a B2 visa on the US Consulate and was granted. But i am worried because I think I accidentaly lied on the ds160 form. i said I was a college student but i am actually not attending classes right now. I temporarily left college (trying To transfer to law school). Can this be considered a lie or misrepresentation if the consulate know about it?

That is the only issue I am worried about. I dont have a criminal history and no relatives living in the US, and dont have the slightest intent to stay more than 2 weeks in the US. Would appreciate if someone answered me :)

I though I could still declare myself as a student since I still have my registration on the university. I know I did wrong. But should I be quiet about it or go and fess up To the consulate? I just dont want To be accused of lying and receive a lifetime ban. This is annoying me

I think you should be fine I would consider myself still 'in college' even if I took a year off.

Since you said you are in the process of transferring to another school, In my opinion this still counts as being a 'college student'. It's not like you've dropped out/graduated and are not pursuing a career,

  • On Oct 13th AOS status was updated to say that a notice was returned due to post office being unable to deliver it. Tier two told me that it was biometrics or NOA1 (even though I had received both before this date).

  • A few weeks later I received a notice dated Nov 10th, in regards to my call about the Oct 13th notice. The new notice said that there were no RFE's or withholding on my case. So still not sure what this Oct 13th notice was about.

  • Received a letter from a NY office on Dec 23rd (dated Dec 10) stating that my medical was over 1 year old. (At this point my medical was only 7 months old)

  • Teir two submitted an internal service request to which I got a response telling me that I need to respond to RFE ASAP

  • Submitted another service request on 1/6/17. To which I got a response on 1/19/17 stating that my case was pending and is outside of processing time (no mention of RFE)

How exactly is the question worded?

Ie, does it say "what is your profession", and one of the options is college student? Then you did not lie.

Whereas if it says "are you currently attending college classes" then you'd have lied.

Either way, I do not think this is material missrep.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Agree with penguin - it depends on the wording. I teach and advise at a university. We consider a "college student" as someone currently enrolled in classes. If they leave the university for any reason or length of time, their student ID is invalidated/canceled. Also, in the U.S. a student does not transfer to a law school. You have to take the LSAT (or in a few cases, the GRE), apply, get accepted, and then matriculate. In almost every case, a bachelor's degree is also required before entering law school (there are some exceptions, such as extremely high LSAT and GPA combination). If you tell U.S. immigration officers that you are "transferring" to law school, well...that might sound strange.

I doubt anyone will care. I hope you have some kind of proof of schooling (ID, etc.). That would help. Enjoy your trip!

You are still registered at the uni just not taking classes so IMO, you're still a college student. Do you still have your student ID? If yes, I wouldn't bother but that's just me.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I agree. My husband was not taking classes but was still registered with the University, he said he is still a student for the K1.

He had to list the classes/courses he took and what dates starting and ending.

It is ok for students to take a break from classes and they are still considered students.

Have a school registration letter for your records just in case there is a question in the future about it.
