It is my understanding that the fee waiver were for those receiving means tested benefits. Do you receive food stamps, or SSI? Also, there are benefits that do not qualify for the fee waiver, such as unemployment benefits.

Although you do not have income from employment, the adjudicator is looking at that you have an ability to cash in assets to pay the fees. Similar to if someone has a savings account or a money market account. You have the capability and ability to pay the fees.

Hopefully, you will be able to find a way to pay the fee. In regards to your legal status, it is imperative that you find a solution to pay versus disputing the denial of a fee waiver.

As I stated, we filed this form based on income (or rather lack of income). According to the USCIS instructions, an applicant is eligible to receive the fee waiver if their income is less than 150% of the federal poverty line. We have zero income so I thought we should qualify based on this.

Not that it is at all relevant but I don't want to pay the fee because we are both unemployed without good job prospects. We both worked in the same industry which is in a major recession at the moment.

I filed fee waiver with my N-400 and it was approved. I simply sent our most recent tax transcript as proof. However, I definitely did not have 60k in assets....

Did you send a tax transcript? You should file taxes even if your income was under the filing threshold for precisely this reason. So you can prove that, if necessary.
