Hello,

My wife entered the states in November of 2015 on a K-1 visa. We got married within 90 days. We are currently in the process of adjusting her status.

I was wondering if anyone knew if there would be an issue with the adjustment of status and eventual citizenship if we qualified and obtained Medi-CAL government provided medical insurance for my wife. My income is below the poverty limit and my parents are co-sponsors. So my daughter and I are currently using Medi-CAL while I transition to a new job.

AOS Journey:

July 1, 2016 : Arrived in US with K1 Visa

August 20, 2016 : Got Married in California :luv:

  • August 26, 2016 - Submitted our AOS Package (I-130 & I-485)
  • August 30, 2016 - Package arrived at USCIS Chicage Lockbox
  • September 6, 2016 - Received text and email receipt notice that i-130 and i-485 application has been received
  • September 10, 2016 - Received hard copies of NOAs in mail for both applications. Notice date is September 3, 2016
  • September 16, 2016 - Received biometric Appointment Notice in mail
  • September 26, 2016 - Biometric Appointment at USCIS San Jose, CA
  • October 19, 2016 - Case is ready to be scheduled for an interview
  • November 1, 2016 - Advance Parole (AP) Document was produced
  • November 5, 2016 - Received the original AP approval notice in mail

Hi Janica,

Yes. I found that government assistance like Medi-CAL is NOT considered a "Public-Charge", so it will not affect immigration status whatsoever. We signed up for Medi-CAL shortly after I found out, while we were in the AOS process. We had the interview last month and it was not even brought up. My wife now has her Green Card and we will be going to Manila for a visit in Feb.

Thanks Jake! I really appreciate your response :)

Because I went here in US with Class B Medical and they advised me to undergo another test just to make sure that I am clear with TB and they apply for Medi-cal for me that is why I am wondering if this will affect my immigration application so Thanks again! :star:
