My wife have approved K-1 with her 5 years old child with K-2 at same time, and is done, we marriage in 90 days. Now we want change status use I-485 also I-765 (Work) and I-131 (travel). My first question is,

1. We need fill I-485 in separate form? (one from my wife and other form from her 5 year old child)

2. Is is it so also, fill I-131 in separate form too?

3. On the I-131 she need to included advanced parole?

Please, anyone who can help me with this 3 question to clarify our doubts. I'll be very grateful, Thank you

Me and my 2y.o adjusting status from K1 (K2) also.. And yes, i sent them 2 sets of forms (one for me and one for my son). We didn't apply for i-131, but i believe you will need to fill out seperate form for your son too.. HTH and good luck!

1.) If I am not mistaken, they can file the I-485 concurrently - using the same form and pay one fee. Please double check this as I have only read this on here and have not done this myself.

2 & 3.) If you plan on leaving the country before your get your green card (which will be several months of processing), you can file the I-131 (I recommend this even if you do not plan on leaving the country), but you will need to include 2 separate ones. If you file I131 with AOS, then you do not pay extra for it.

Apr 25 2016: Children received P4 letters in the mail

Jun 03 2016: Received Visas

We have done AOS for K1 and K2.

Each applicant needs a separate form for I-485, I-131 and I-765

You file them at the same time and the child's fee will be less than the adult's fees if you file them together. Your wife and her child each need their own forms and their own supporting documents, with the exception of the Affidavit of Support, where you place the original with your wife's application and can submit copies for her child.

You are mistaken. They each need their own forms and pay separate fees.

Ok. But, what part to be filling on I-131? In my case, I have my mother in law probable, she will die in the next 6 month or less by medic certificate letter document I have with her health condition and we don’t know when we travel, we prepare for this next emergency trip, so...

Part 2 - just to be select 1d,

On part 3, 4, 5 & 6 is N/A, just skip to part 7 no. 1 select “more than one trip” and N/A to the other question on part 7 then automatic Part 8 signature. This is correct? Remember I will send I-131 with I-485 together.

At the bottom of page of 2 it states this : If you are applying for a non-DACA related Advance Parole Document, skip to Part 7.

Yes, Part 2 is d.

If you have no date and length of trip, then you can leave it blank and hand-write Unknown after printing it out, or put N/A.

Part 7 you check 'more than one trip', the rest will be blank, and you do not need to supply an extra statement. No explanation or reason is needed when filing the I-131 with a pending I-485 as an adjustment applicant.

Yes, you sign in Part 8.

Don't forget to file I-765 forms for each too, and get an EAD/AP combo card for both the K-1 and K-2. The fees for the I-765 and I-131 are waived when filed with a pending I-485.
