Hey guys!

I'm from Brazil and am gathering the docs to send to USCIS. My birth certificate is in portuguese, do I need a certified translation? They don't even require my brith certificate to file the petition, only my american fiance's, but it also states that all documents have to be translated if not in english, so I'm confused. I would like to send as much information possible so it doesn't come back requiring more data.

Also, there are some forums around facebook also stating that if your interview is in the country that the documents were written, therefore same language, you don't need to translate them at all. Besides birth certificates, police reports and such. Will I need that translated afterwords for my Adjust of status?

Sorry I had too many confusing questions and thank you for any help you can get me!

Hi! For the K1 you shouldn't need to translate it and you are right when you mention that they don't even need to see your birth certificate, at least for the first part. You might need to bring it to the interview but it won't need to be translated. If it was in Russian or any other language other than the national language you will need to have it translated.

For the Adjust of Status I suggest that you get two or three certified copies of your birth certificate when you come to the states. You'll send a copy of the Birth Certificate but have several original copies on hand for other things that you may need it for. For the AOS you will need to have it translated. Honestly I did it for my husband myself and translated absolutely EVERYTHING including the stamps (hah probably went overboard doing that, but one can never be too careful).

Also, you don't need to send your birth certificate for the initial filing of the paperwork. If they don't list it as something to send, don't send it...because you won't be getting it back. At this point they ask the US Citizen for a birth certificate just to verify their citizenship and to verify that they are able to petition for this visa. They won't do anything with your birth certificate at the initial filing stage

Hey guys!

I'm from Brazil and am gathering the docs to send to USCIS. My birth certificate is in portuguese, do I need a certified translation? you dont need ur BC to file the petition. but u need it translated in english later on at nvc and at the time of ur interview.

Also, there are some forums around facebook also stating that if your interview is in the country that the documents were written, therefore same language, you don't need to translate them at all. if your civil documents are written in foreign language then u need both translated in english and original ones.

Besides birth certificates, police reports and such. Will I need that translated afterwords for my Adjust of status? dont know about police report but u need ur BC in USA also for further processing thats what i ve heard from others who have done already.

The foreign fiance(e)'s birth certificate is not sent with the I-129F petition. The USCIS now has a checklist available on their site where you download the form > https://www.uscis.gov/sites/default/files/files/form/m-1151.pdf

When it is needed later for the K-1 visa interview, it will not need to be translated >

http://brazil.usembassy.gov/interview.html

Translations: If your documents are written in Portuguese or English, there is NO need to translate them. If the documents are in other languages, these must be accompanied by official translations to English.

After you are in the US and filing for AOS, then you will need to have an English translation along with a copy of the original for the I-485.
