DCF Thailand filed on April 8

I (Thai) and my husband (USC) filed I-130 (IR1) at USCIS Bangkok on April 8. My question is how long do we have to wait? It's been 21 days (I have seen a lot of people got approved within 2 weeks)

*about us, We have been married for 6 years (have a 5 years old son who is officially an american citizen). My husband has been working in Thailand for 8 years and holds a NON-B visa.

Remember the embassy is closed on both Thai and US holidays.With all the Thai holidays lately, I am sure there is a week lost, but you should be seeing it soon

I think it depends on the person working on the case. Someone got e-mail, We did not, We were just sent the packet 3. We got a 2 week e-mail reminder for the interview, and they did not. You are the second being petitioned by an Oregonian I have seen on this site ( they got approved over 6 months ago), Good Luck. I will be back in Oregon with my wife May 26th.

Your the second Oregonian I have seen petitioning for a Thai, Good Luck. I will be back in Oregon with my wife May 26th.

I'm not a petitioner. My husband is. Anyway, he gave them a call telling them that he got a job offer and needed to go to an interview before the end of june, they said they would rush the case. It's been a week since then and we are streesing out. Good luck to you too!

Thank you for the information you have provided. I hope that you could offer my wife and I some more clarification on the IR1 process.

Today, 6 JUN 16, we filed the I-130 at USCIS-BKK. After reading several posts today, we have realized the process does not take as long as we first thought.

On average, how long is the overall process (ie. when visa is approved)?

Originally, we believed the process would allow us to stay in Thailand for one more year. But, now, we are starting to believe the quick timeline in BKK will not allow. I suppose we need to start planning on our move to US sooner than anticipated.

Lastly, in Thailand, how long is the medical checkup good for?

We got ours from filing the i-130 to interview and approval in around 90 days, but you can take much longer if you want. I am not sure how long the i-130 is good for but after the i-130 approval you do not have to send in the i-864 and supporting docs right away, maybe months, then you can delay the interview after the embassy sends the packet 4 ( interview readiness packet). Medical is good for 6 months and the embassy warns you not to get it too soon if you are planning to leave at a later date as the visa is only as good as the length of the medical validity.

An I-130 is approved indefinitely. Once approved it will be processed by the National Visa Center if you are seeking to bring your spouse to the US from another country. You can keep the case open with the National Visa Center as long as you keep in contact with them at least once a year.

Once the year passes however, you will have to repay certain visa fees. And if you fail to contact the NVC every year they can close your case. You also at that point risk USCIS destroying the file.

Dear Gradtaai,

Thank you for your reply and for the further research you have conducted. I suppose my wife and I will have to drag our feet when submitting our docs. This is the best way to maintain in Thailand closer to our goal date. Of course, as you recommended, we will keep in contact with the embassy as to not close our file.
