Question, I am confused on which form to fill out in regards to affidavit support. is it the i864 or i134? Which form do I use??/

I have seen a mix of both being used. I personally used the I-864 & the I-864A because I had a co sponsor. I've also seen people using the I-134 as well. I think the guide on here tells you to use the I-134. My petition was approved at the USCIS stage so I had no problem with using the I-864.

The i134 is for k1s, the i864 is used for immigrant visas and for aos after arriving in the USA with a k1. Sending an affidavit of support with the i129f is useless, it's only needed at the interview

The I-134 is for The K1 the I-864 is for the AOS or for a spousal visa. You had no problem using the I-864 with USCIS because they don't care about that. You will have to send a I-134 with your fiancé to take to the embassy. People use mixed poverty guidelines. They say use the poverty guidelines for the K1 from what you would use for the AOS because the I-134 you only have to be 100% over poverty guidelines. For the I-864 which you will need anyway for the AOS you need to make 125% over poverty guidelines. Sorry but from loading is good cause the CO gets to read it but your approval from USCIS had nothing to with your I-864 that's for the interview only.

Remember that the i134 alone doesn't help. You and your sponsor need to send the supporting documents as well, plus your sponsor needs to send a document for proof of citizenship or green card if lpr.

I just don't want you and your fiancé to get to the interview stage and have to wait even longer. If you sent the I-864 the CO will see it when he or she looks over the case which is not a bad thing. They say the CO sometimes makes his or her mind up before the interview so I can only help! Good luck!!! Have fun in Finland!! ?

I originally planned on filling out the I-134 and then the lawyer I had said no do the I-864. I only got a lawyer to look over the documents and for extra help. Apparently he doesn't know what forms are for what ... <_< Hopefully if my fiance has the correct forms in hand they'll be happy with them! But thanks for the help :thumbs:

But there are documents you have to send/ give yo your fiancé specifically for the interview. No matter what you sen on your i129f.

Yes, I started collecting those about a week ago. I have mostly everything from that guide. I'm just waiting on a couple of things :) I will take it all with me when I go to visit him in Finland.

Do we really need to send the entire 129f package and intent to marry? I do not have a copy of anything because I used a 3rd party agency to send my documents to uscis....any thoughts?

Your embassy/ consulate may require an updated letter of intent to marry, check within your regional forum or directly with your embassy/ consulate. If needed, you'll send that, if not, cross from your list.

The i129f package is not needed for the interview, as they receive that from uscis. But it's advisable for the fiancé to have it so they can study it and know everything that was filed.
