So far we've asked 4 different people to sponsor my husband. The first said no. The second said yes, but hasn't even filed his taxes yet for 2015. He filed an extension and is having issues with it. The third said yes, then said she did some research and decided not to take the risk. The fourth is still thinking about it, but I haven't heard back from. I have a full time job and have been applying for part time jobs and will start doing interviews soon. Hopefully I'll be able to get another job soon so we won't have to rely on anybody else. We're hoping my husband will get his work permit soon. If he does get a work permit and a job, will his income really count for our household?

If your I-864 is not suitable you will get an RFE which will hold up the work permit, so no.

If he had a work visa and was working before you applied for AOS, and the work would continue from the same source after AOS was approved, then you could use his income to qualify.

But that is not the case here.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!
