We are on the process applying for Green card and we (me and my wife) are thinking to process the papers of our daughter.

My question is, if my daughter will be staying for a couple of years outside US (3-5 years for example) and she was granted the green card this year or next year, would there be a problem if she will be not in US

for the next 3-5 years?

Thanks in advance for the reply.

Why not wait?

You could get a re-entry permit, but gthat usually only lasts 2 years.

If you are already sure that she will definitely finish her studies over there, I recommend having her do that and then petition her for an immigrant visa (takes about a year).

If it definitely in the 3 - 5 year range then it is best to just wait it out.

Hi! We are also planning the same for my eldest daughter. She has only 43 units left on her degree so she will come back after getting her green card to finish the 3 terms and take her board exam, she is 19 now.

We will apply for a re-entry permit for her and she can come back and visit every Christmas until she get's her license in PH. They key here is apply a re-entry permit with max validity of 2 years and let her come back in the US in between the 3-5 years. Take note that if she lost her LPR status you need to petition her and if she is nearing 21 the timeline could be tricky. So make sure that she come back and visit in between not exceeding one year out of US or when you have a re-entry permit that is valid for 2 years. I have some friends who did this and had no problems as long as you have the re-entry permit and let them come back to the US during Christmas break.
