Hi everyone,

I have questions about I-864. Can anybody please answer it?

I filled the I-130 and I-485 in March for my mother who is currently in the U.S.

I received receipts and, and my mother’s biometric appointment is scheduled on May 17th.

However, I got a letter (yellow paper) today: Request for Initial Evidence (I-485)

I am the sponsor, but I don’t have enough income. Therefore, I have my husband as a joint sponsor (He filled I-864A).

When we filled the form, I accentually forgot to type my name on page 3 part 4.

Here is the letter a received today word by word:

1. Form I-864, Affidavit of Support, was submitted; however, Page 3, part 4 of the petitioner/sponsor's Form I-864 list someone other than the petitioner/sponsor or Page 3, part 4 is blank.

Submit a completed and signed Form I-864, for the petitioner/sponser listed on Form I-130 or Form I-129F. Even if a joint sponsor will be used, the petitioner/sponsor must submit Form I864. Also, provide copies of the petitioner/sponsor's most recent federal income tax returns and all supporting tax documents (W-2, 1099s, Form 2555, and tax schedules) .

2. Form I-864 Affidavit support was submitted from a joint sponsor; however, the names listed on Page 1 and page 3 are not the same

Submit a completed an signed Form I-864, from a joint sponsor, provide copies of the most recent federal income tax returns, all supporting tax document (W-2, 1099s, Form 2555, and tax schedules) and evidence of their status of United States Citizen or Permanent resident.

MY QUESTIONS:

1. I understand that the cause of this is I forgot the fill Page 3, part 4. I will update Form I-864, but do I need to resubmit all supporting documents?

2. I don’t understand the second requirement. What means “the names listed on Page 1 and page 3 are not the same?” the page 1 of I-864A is my husband’s name (information about you, the household member) and the page 3 is my name (I, the sponsor, ***). These names should be different. Do I misunderstand anything?

2. I am not sure what the exact wording of the I-864A is where they have a problem with it, but perhaps they want your husband's name in both places?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No. 2 in the list is not about i864A, it's about i864 from the joint sponsor. You said you had your husband as a joint sponsor. Where did you mention in your petition that he is your joint sponsor? If you are including his income as a household member, he is not a joint sponsor. If you have included him as a joint sponsor, he should submit i864.

#2 states a joint sponsor filed an I-864 and the name on page 1 and 3 do not match. They should both the sponsor filling out the form. Did you not have a joint sponsor file their own separate I-864? Who filed an I-864A?

Hello- I'm in the same exact situation. I filed in June. MY I-130 got approved but still waiting on notice for I485. did you case get approve already? Just wondering what to expect since we have the same exact case. Your feedback is greatly appreciated. Thanks

i also have the same issue. my wife filled as the only sponser and we left page 3, part 4 blank but we never put anywhere about a joint sponser.

im assuming the two go hand in hand, if you forget page 3 part 4 then it automatically says you filled as a joint sponser.

any help here?

Yes, parts 1 and 4 need to state the sponsor. Did you guys tick "yes" also on Part 3 Q1?
