So, our interview is next week for our K-1 visa. And I think I may have answered question 34a incorrectly in the original I-129F petition. Since it is already at the consulate though, I'm not sure there is anything we can do to correct it besides bringing useful documentation to the interview.

Here's what happened:

I sent in the original petition/they received it in early January. I got an RFE for a different reason in late February, and approval in mid-March. I didn't find this website until after my first RFE, and didn't even think about this issue until the past couple of weeks.

On the petition, questions 34, 34a, 35 and 35a are all related. Here are the questions and my answers.

-Question 34 says: "Has your fiance met and seen you within the 2-year period immediately preceding the filing of this petition?" (I answered "Yes.")

-Question 34a (where I may have messed up) reads: "Describe the circumstances under which you met. If you have not personally met each other, please explain how the relationship was established. If you met your fiance or spouse though [sic] an international marriage broker, please explain those circumstances in number 35a. Explain in detail any reasons you may have for requesting that the requirement that you and your fiance must have met should not apply to you." (I answered: "We met when I, the petitioner, traveled to Morocco from July 20th to August 4th, 2015." I also attached copies of my travel documents proving I was there.)

-Question 35 says: "Did you meet your fiance or spouse through the services of an international marriage broker?" (I answered "No.")

-Question 35a I did not answer because of my answer to question 35 (We did not meet through an international marriage broker.)

What I think I did wrong:

While my original answer is factually accurate (we did meet, in person, last summer), we originally met online in January 2014. I am 100% positive that the website would not be considered an international marriage broker (it is a free social networking site for meeting people all over the world) and will make sure that my fiance takes proof with him that it is not a marriage broker.

As evidence, I am planning to send my fiance to his interview with: a screenshot of the About section of the website, the text of that section describing it as a free website (including the words: "... [the website] has been the Internet's premier free site for online correspondence, cultural exchange, and learning foreign languages."), and the Terms of Service for the website. Is there any more evidence I should send regarding this issue?

I answered the way I did because the question that it is attached to (question 34) is regarding the meeting-in-person requirement- I figured that 34a was asking to describe the circumstances of that meeting, as opposed to the initial contact. I'm worried that my misinterpretation could be an issue at the interview.

What do you guys think? Is there anything I can/should do besides send evidence with my fiance to his interview? Are we screwed?

Met is in the conventional sense. We have not met.

You only need to have met once to file the K1, he will need evidence of your other meetings for the interview.

The web site terms and conditions should do but normally that would be a RFE issue.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

We also did not add evidence that the site we met on wasn't an IMB and we didn't get a RFE. I would think if it was going to be an issue you would of been notified long before now but that been said by all means take the evidence of the terms of service along to the interview and produce it if asked, I personally wouldn't make it an issue at the interview and point it out.

Good luck :)

You're doing the right thing. I don't think you'll have any issues, but it's a good idea to bring the proof with you in case they ask. And yes, that 34a is a confusing question. They do mean it as how you met in person in the past 2 years. Then because you didn't meet through a marriage broker, you don't need to answer that question, but lots of people are getting IMBRA RFEs for things like OK Cupid. So who knows. Either way, it's more a USCIS thing not a State thing but have the info just in case.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED  (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding!

this is off topic so I apologize in advance but how does the Moroccan embassy schedule the k1 interviews? Do they tell u the date of interview or are u able to schedule your own? Did you have to create a profile on CGI Federal to print the payment slip to pay for the DS160? I'm at that stage now and I am seeing all kinds of different information. So....I figure I would ask someone who already went thru it :help: after I get the NVC #, what should I be doing after? DS160 is filled out. Waiting to send it.
