Request for second i864 for interview

Hi,

I'm new to posting on the forum but have picked up some good advice here. Perhaps someone can advise, or has encountered the situation my wife and I find ourselves in.

My wife (US citizen) and I (Irish citizen) currently reside in Ireland. We are going through the process from Ireland, with my wife set to reestablish her US domicile when we move. She is my sponsor.

We are currently case approved at NVC and have been scheduled an interview date at Embassy. However we have received an email yesterday asking us to present a second completed I-864 AOS at interview.

The reason cited is that we did not meet the minimum income requirement. On our i-864 we filed $0 as our income, as neither of us have jobs in US at present. However we cited sets of assets in the US and in Ireland, both sets of which are well in excess of the minimum income requirement.

We intend to ask my wife's father, at whose home we'll be residing on landing, to fill out a second I-864 to sponsor me.

I am just wondering if anyone else has come across this situation? My wife spoke to an official at NVC who advised us that the case was complete but that we should bring the form nonetheless.

I would have a joint sponsor as back up but try to do it with your own assets first. Have the extra I-864 from your FIL (father-in-law) handy at interview. I think penguin had issues with this as well through Dublin.

I think your issue is NVC, not what the embassy will think. NVC regularly asks for a co-sponsor when the income is below the threshold/ no income, even when assets are listed (and that part is not just for Ireland).

In my Ireland-specific experience, the CO did mention he was glad our assets had already been moved to the USA (we bought a house there in anticipation of moving, and moved all but our "daily living expenses money" to my USC husband's account in the USA), so if you can, move as much as possible prior to interview and have proof of that. We were approved that way, even though I stated at the interview I didn't intend to work in the USA at all, as I had twins only a few months before interview.

If your father-in-law doesn't mind filling in the I-864, I agree it would be a good idea to have it ready, don't present it unless they seem doubtful at the interview, just have it as a backup.

NVC always sends a checklist when you use assets because whether or not to accept assets in lieu of income is at the discretion of the CO conducting the interview.

We used assets alone and they were all in my name in Sweden. I had to write a letter explaining the assets and signing to say that we intended to move the assets to the US within a year. I also needed a letter from my Bank Manager verifying that the money had been in my accounts for at least a year and how much I had in local currency and equivalent to USD.

I thought my post is not a hijack. OP is asking anyone experience like him. Yes. I did have it. I am trying to share my experience with him.
