I-864 AOS Question reguarding proof/evidence

Filed: K-3 Visa Country: Morocco
Timeline

In reguards to the I-864 AOS I have listed the following to submit with the application/form:

I-864 application/form, signed and Notorized

Last 3 Years tax returns corresponding W2's for each year filed

Authorization for Release of Federal Tax Data , signed and dated

Copy of Passport for Sponser

Last three Paystubs dated within 1 month of signature on the I-864 application/form

Is the "proof" of the last 3 years tax returns the 1040A that I have from my filing through H&R Block?

Also, Last Year 2005 my income doubled what is expected to meet the 2006 poverty guidlines and currently I hold the same position and have no problem proving my current income meets and exceeds this poverty level. My question is in reguards to my 2004 and 2003 income. I had a child and cut back on my work which then in turn shows less income ( that does not meet the poverty guidline) for these two years. Does anyone know if this poses a potential problem? Prior to these 2 years I had met and exceeded the poverty guidlines but from what I read they only want the last 3 years and current income.

In addition to these items listed above...am I missing anything?

The I-134 is used for K visas. Only on the VERY rare occasion have I noted an I-864 being an option for a K visa. I-864 is used for immigrant visas and for Adjustment of Status. You will use the I-864 when you adjust in the US.

You now only need to submit the most recent year's tax return for the I-864. So don't worry about 2003 and 2004, they won't even be looked at.

The I-134 is used for K visas. Only on the VERY rare occasion have I noted an I-864 being an option for a K visa. I-864 is used for immigrant visas and for Adjustment of Status. You will use the I-864 when you adjust in the US.

The OP stated that she is completing the I-864 for AOS.

I-864 AOS is what was stated.......putting the 'for' in between changes it somewhat. From the OP's next posts it makes it clear they are referring to Affidavit of Support for the K-3 not adjustment of status.

Morocco requires the I-134 with 3 years of tax returns as support.

Thank you so much for your reply and the information about the I-134. I've taken the time to read over the instructions and the form.

Is the "proof" of last 3 years tax returns the 1040A form I have from filing each year?

It's a relief to think that the 2003 and 2004 income isn't going to be an issue...does that still apply with the I-134?

Do you know if I can immediately obtain the letter from my employer and sign and notorize the I-134 without violating any time limit restriction? The information, as I read it, on the I-134 instructions lead me to believe the signature and the notorization is good for 1 year.

Even though in general the I-134 only states that only the one most recent tax year is required, there is plenty of occasions when the 3 most recent are required for those applying for a K visa. As jenn3539 has posted, Morocco apparently requires 3.

To explain it a little. The I-134 is used in the main for non-immigrant visas when required. K visa's whilst they are non-immigrant visas are in many ways processed the same as an immigrant visa. The I-134 is used as one of the things that a Conof will look at in determining if the applicant will or wont become a public charge once in the US.

Affidavits of support are good for a year, yes. I am not familiar with the form name but if the 1040A is the tax return then yes.

Timeline

Morocco will look at income from all 3 years at the interview, not just the most recent. When you adjust status in the U.S., only the most recent year will be looked at.

That said, I was panicking because I met the income requirement for 2003 and 2004, but not 2002 because I was still in school then. I was told that I should try to find a co-sponsor. We took the risk and went with what we had. Turns out the CO in Morocco never even asked to see the tax returns, or the I-134 itself for that matter.
