Hello,

What form should evidence of assets take concerning money in savings?

Is providing bank statements sufficient? Does it need to be from a set period?

For house valuation, will a lawyers letter be sufficient?

And on a slightly different part of support,

Will a letter from Petitioner's employer specifying start date and salary suffice?

Salary alone would be sufficient for the 125% but as they've yet to start, have no pay stubs, etc.

Or we can use assets (house) to evidence the 3x income requirement, am I right that this would be around $60,000? Or have I missed a trick.

You cannot use your home. It might be an asset, but is not a liquid asset, as you'd still need a place to live. Also to use a home you need a current appraisal by a licensed appraiser or tax statement and evidence of all loans on the property.

from the instructions "Only assets that can be converted into cash within one year and without considerable hardship or financial loss to the
owner may be included. The owner of the asset must include a description of the asset, proof of ownership, and the basis
for the owner’s claim of its net cash value." selling the place you live is usually considered a hardship, as then you have no home.

Bank statements must show the balance for at least the past year. A sudden large deposit will not be accepted.

Hire date, salary rate and notice that you are currently employed.

The answer to your math question is impossible to know as you haven't given all the required variables on what your shortage in income is. The instructions of the I-864 go over all of this.

What if it's the beneficiaries UK home?

We have the property valuation, and the lawyers statement of ownership, etc.

We'd still have the US residence we intend to move to.

The issue is more, at present for the US perspective, we would have 0 income. The petitioner and beneficiary are both relocating to the US at the same time, with the USC taking up employment at that time, with a job already secured for 60k annual. So if this is accepted, we have no issue. It's if this is not accepted we have to use assets.

It's this eventuality I'm trying to account for. The house will be sold, as it's UK based.

Why would large deposits not be accepted? We've recently sold, house contents, and a car, so that alone is a large deposit.

For the UK Embassy specifically it states,

K and Diversity visa applicants are not required to provide an I-864 Form. However, they must show evidence that they are not likely to become public charges while in the United States. There is no set for that this evidence must take but use of the form I-134 is an efficient way to provide this information to the Consular Officer.

Again, specifically for the UK, Would this be a judgment call for the Officer, if we can show sufficient liquid assets, and evidence of pending employment? Is it worth pursuing a joint sponsor to be safe?

Also, specifically for UK we do not complete the I-864, the I-134 is a suggested template.

Generally they see a large deposit, as something borrowed to get around the income or assets requirements. If you have proof of those sales, then yes you can use it, but you'll need to show documentation of the sales that generated those assets.

And yes his assets can be used, like his home in the UK.

Sorry, I'm used to seeing the borrowed money, or someone wanting to use the home they reside in as assets.

A second home, a second car, are usable assets, even if owned by the person being petitioned.

Do either of your have retirement accounts? That's another asset that can be used.

I would hope so. Is it written as an employment contract?

It's not 'a contract' per say, like none of the terms of employment etc.

But, it essentially says, "welcome aboard, you start 1st August, Salary of x, position of x, see you then"

It sounds good to me then. One thing to understand with the K-1 visa, the income requirements that need to be met are just recommendations. The CO has 100% discretion to decide if the person you sponsor is likely to be a burden. They can literally give the OK to someone who doesn't meet the requirements technically, or deny someone who meets them. Often they judge it based on if they think you will be able to pass the AOS requirements after you enter and marry in the USA.

I guess we can just go to the interview with as complete a picture as possible, and show them we won't become a liability.

When I went through this process in October 2013 (wow only seems like yesterday) the deal seemed to be that as long as you could prove you were financially secure and could cover yourself until AOS you'd be OK. This is of course a sweeping generalisation. The US embassy at that time were far more relaxed about the affadavit of support than just about any other embassy worldwide.

I was the UKC and my then fiancee was the USC. She was just finishing her nursing training and apart from some alimony which took her over the poverty line (just). So my money was a big deal . I did not have a job to come to. I just had the proceeds of my UK house sale. That said the sale was agreed at the time but I did not have the cash in the bank. I did have some money I borrowed from my mother - so lump sum + car sale so another lump sum. So a few red flags ?

Nope. I provided the embassy with an online bank statement, showing I had cash in the bank (that day) and confirmation from the estate agent of the house sale offer , mortgage statement and little spreadsheet showing how it would wash out on final sale.

In the end all they kept was the bank statement and that was obviously two lump sum payments.

This was OK for me. I did make it very clear where my money was and where it was coming from. I made it as easy as possible to OK my application. I'm also a middle aged white English bloke in a low fraud country. I suspect we have it easier than most.

Has anyone recently used the I-134 for assets of a USC who is only just returning to the US.

We checked and it's asking for US holdings, not total value, so money in UK accounts isn't valid?

Also, can we use the income of a job not yet started as annual income. The form isn't exactly clear on this part. Or am I 'selectively' reading it?

The evidence part says, date, salary, company stationary, and temp/perm.

As we're just evidencing that we can meet the income requirement once we're back, and this would cover it, is this acceptable to do?

They will take UK money or house or whatever. It is totally subjective. K1s can self-sponsor themselves. If the house or assets are in the UK person's name, then take whatever shows the value and no I-134. It doesn't require 3 times any figure. It's whatever the officer thinks assures him that you won't become a public charge. If the U.S. Person owns the assets, then take the proof and an I-134. (Foreigners don't fill out I-134. Americans do).. Future job? Not aware of anybody doing that exactly so don't know. Try it. It is not strict like an I-864 for spouse visas. You don't need to show 12 bank statements either. Bring the latest.
