My wife and I are in the midst of an AOS from what was originally a tourist visa. We traveled back to her home country on advance parole in February because of my wife's grandmother, who is very ill. Our lawyer originally said she thought we could stay for up to 5 months here if her grandmother didn't improve, and that based on current wait times the interview would most likely be in September.

Of course, we just received a notice for an interview for June, which is about a month earlier than we had originally intended to return. My wife is very close with her grandmother, and has basically been acting as a nurse for her, so our preference is to delay the interview IF it does not affect her chances of obtaining a green card. We emailed our lawyer (who has been very good and is quite experienced), and she said postponing should not affect her chances.

The interview notice listed hospitalization as one reason for delay; while not hospitalized, her grandmother is bed-ridden and essentially paralyzed.

I just want to post this to see if anyone has had a similar experience and has any strong opinions as to whether or not we should delay?

Honestly? If you really absolutely trust your lawyer, go with what she said.You are paying her for advice. She studied the law and probably has more experience than any one on this site who isn't a lawyer.My advise would be to document it, like medical receipts for any care she is getting. Hospitalization means different things in different countries. For instance hospice care isn't "hospitalization" but I dont really think any one would knick you for the subtle difference, after all you are dealing with people who see this kind of stuff all the time. The only variable is the officer handling the case, if he she is new etc.
