How could this be considered an emergency situation? Seems irresponsible to give false hope. Presumably the OP wasn't forced to flee Canada. The OP doesn't mention anything drastic changing between now and the time they left that would put the daughter in imminent peril. As others have said, not being properly informed about immigration law doesn't constitute an emergency - the OP is free to abandon the AoS process at any time.

Seriously...any claim that the daughter is dependent on him/her seemingly went out the window once the OP chose to leave her behind to go live in another country.

No one said they know everything. But there are several people here who have looked into what qualifies as an emergency situation, and attempted to have their cases expedited based on their health issues, and even more serious health issues have not seen any compassion on the part of immigration. There was a USC who had a brain tumour and her husband's case was not expedited. I have known of one case where it was granted and that was when the USC was having a liver transplant. His child's case was expedited so she could be with him as there was a strong chance he would die.

There is a huge difference between what would qualify as an emergency for expediting a case (i.e., I-130 petition processing or visa processing) and dealing with the numerically limited visa categories -- the law that governs these categories really has no provision for expediting a case until a visa number is available.

Down syndrome is not a terminal condition.

My previous job I had a coworker with Down's that was doing manual labor. He was married and had worked for the company for over 20 years. His pension was better than mine!!

There are different variances to Down's Syndrome. Your co-worker led a pretty "normal" life. My sister, on the other hand, will never be able to take care of herself.

OP, if you choose you can make your daughter a ward of the court. They will find her a home that suits her and her needs with caregiver that's properly trained. Or you can choose to live in Canada with your daughter until her petition from her sister becomes current at which time your other daughter can also petition for you.

Y'all kno very thing about immigration right?? I am not going to go in details about anything but like I said she can fall under special circumstances and should seek legal advise. You know what I just ate my favorite food and I'm really full. Will come back when I'm at ease.

Well from what I know and have witness, immigration is unpredictable. Trust me I can tell you what I witnessed which aggravates me till today but it really happened. A spouse of a green card holder came in this country. the lady had been living in this country for just 2 years prior and brought her husband here in just one and half years later because she was struggling financially( recently had a baby) and she was even a burden to the state. The state had to provide accommodation for her and her spouse. I don't know how to type it but just wrap your head around and understand it any way you want. Yes her husband came here for such stupid reason.

I can go on and on about cases I have witnessed. Immigration is "to each is his/her own". I'm here taking advises and jotting notes but I know my journey is different from anyone else and therefore I'm not comparing time or nothing. I know someone who is illegal and was provided work authorization letter too. These are people I see everyday not hear say.

"brought her husband " do you know what visa ? If she had been here 2 years on a green card then had she filed when she arrived the wait for a spouse of a green card holder is about 2 years so there is really nothing unusual in your case. She could have gotten a co sponsor the world is full of people stupid enough to co sponsor total strangers. That will not affect the wait time for an adult child it is a different class of visa and that wait will be a long time. It amazes me that it is supposed to be important for the government to rush this process but the woman is completely ok with leaving the daughter behind if she doesn't get her desired fast process.

This will not be over quickly. You will not enjoy this.

Okay thanks everyone. Seems this got off the rails about 15 comments ago. Like I said earlier "my daughter is with family for now", she's 32 and part of an active day program and quite happy. I would just rather see a path to having her here with me. If that is not in the cards in the short term, there is plenty of time we can spend together there and here. Thanks for all the comments and opinions. If I wasn't here in the U.S., unfortunately I would not be able to afford to look after her there - short term or long term. I definitely have not "left her behind". Thanks.
