I-140 NIW sent, when should I apply for AOS?

Hello,

I am on H1B. My wife is on H4. We applied for green card (EB2 - NIW) 2 weeks ago and received I-140 receipt last week.

We can either apply for AOS now or after I-140 approval. My employer agreed to pay for my I-140 and AOS but not for my wife.

Could I apply for AOS first while my wife do the AOS after I-140 approval? If that's possible, what is my wife's visa status after my AOS approved but her AOS is still pending?

Assuming that you are the primary applicant, you should apply for AoS together. Otherwise you would need to sponsor her after you become LPR but that's gonna cost more time and money. So you can risk losing one application fee (for her) and apply now for both or wait till your I-140 is approved and then apply for AoS for both.

It also depends on how long your H1B is valid and if your employer is extending it. If you plan to work on EAD then your wife will lose her H4 benefits (together with your H1B) so for that reason too you should apply together and get EAD's for both.

12/23/2016 USCIS suddenly changes several forms, invalidating my EAD/AP renewal package (not yet sent)
12/27/2016 USCIS suddenly reforms the entire NIW criteria system, replacing a 20 years old one. Uncharted waters. 
01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)
09/14/2017 I-140 NIW approved!!! 
11/28/2017 RFE for new medical issued (plus another request re Supp J for employment which is clearly issued in error)
12/04/2017 RFE received in mail
12/07/2017 repeated medical exam for I-485
12/08/2017 Attorney receives documents for responding to I-485 RFE
12/21/2017 Response to RFE received by USCIS 
02/09/2018 I-485 approval (text, email) :)
02/08/2018 I-485 approval notice issued (the "welcome letter") - I'm LPR now
02/16/2018 Green card received

Also, if you don't mind me asking, which service center is processing your I-140? If it's Nebraska (receipt numb starting with "LIN") you are looking into 8-12 months and then additional 4 or so months for AoS. So if time is a factor at all, I would recommend filing for both ASAP. On the other hand, if your H1B can support you for 12+ months, the safest way is to wait for approval of I-140.

Thanks randomstairs. My employer could extend the H1B as needed and my H1B has around 1 year left so I am not too worry about time. The service center is Nebraska. I will wait until I-140 approved.

Sure thing. Make sure you start renewal of H1B at least 6 mo before its expiration. Nebraska is currently being very, very slow (about 250 days for I-140 NIW) so even though you are not in a hurry, you should apply soon. Good luck!
