She had a visitor visa and had been here 2 times prior. This time her ticket was to stay 5.5 months. I get a call from immigration when she landed in Seattle asking me if I'm expecting a visitor tonight? who it is? how long I knew her? etc. I ask him what this is about and he tells me I am not to ask questions, he will ask the questions! He than goes on to tell me they are screening for terrorists! At this time I'm freaking out as she is nothing of the kind! He asks me if I am her fiancé (I am not but we intend to live together someday) I tell him yes. He asks if we are going to get married,I tell him yes. He asks when, I tell him don't know. I am answering all this because I'm thinking it must be "quota" time and he needed to pull someone and I did not want her to be suspected of a terrorist. The guy was a complete a..hole the whole time. I'm looking at the clock and ask if she will get on the plane as she has 7 minutes, he tells me not to worry about the plane. Tells me to be by phone in case anymore questions. I don't hear back and go to the airport to pick her up and she's not there! check with airline and she is not registered! I call Seattle immigration and they say they are sending her back to Thailand and I need a K1 visa for her.

They have taken her visa!

My question is will this affect us getting her a K1 visa?

From what I am reading here.

1) Girlfriend

2) 5.5 Month intended stay

3) Answers "Fiance" when she is not. If she said girlfriend, inconsistency.

4) Answers "getting married". If she said no, inconsistency.

5) Answers "I don't know to married" when. Didn't help his case.

6) If she told CO going to school.

3/4/5/6 probably raised a number of red flags on their own enough to get a denial of entry.

2 most likely blew up the process. I can't see Customs Officer letting that one slide no matter what. It screamed "Intent to Immigrate" Especially, with a B-2 Visa.

Of course staying 5.5 months sounds suspicious and they will definitely tell you to get her k1. 5.5 months was too long to stay on a visitor visa. Sorry but hope things work out. Long stays always end up like this. Good luck

I thought tourist visa is given to US only for one month.

09/27/16: BIO early walk-in (10/06/2016)

10/05/16: I-485 RFE email received

10/11/16: RFE yellow letter received/RFE package sent

10/13/16: RFE package delivered (USPS)

10/14/16: RFE package received by USCIS (Email received from USCIS)

11/23/16: I-765 was approved. Card ordered (Expedite processing/Job offer)

6/13/17: Interview. Not approved in the spot. IO wanted to check for gonorrhea test on I-693. She said maybe we could get RFE.

6/30/17: We received the card.

No it was the opposite, he didn't stick to the truth and he got into trouble. She is not his fiance, they're not getting married now but he said she was his fiance and they're getting married.

Everybody that comes and stays a long time or everybody that applies for a visitor visa dont always do wrong. There are some honest people in the world. Always be honest.

I was screwed too, by my ignorance and because I said the truth.

Once you are not about to go against the law, you have to be strong until they realize that you are not a bad person.

What can we do?

I was treated really bad, I felt like a criminal and I´m really far away from that.

I work in an international airport! So I passed through a bunch of criminal screenings on my country, at my work I reach ALL areas at the airport and I deal with the Federal Police all the time... and still like this... I got the same situation.

Keep your relationship strong, and go for a different visa. That one that really fit your intent.

I say that my biggest target is live with my partner, it doesnt matter where. He just don´t come up, because he don´t speak the language and my country is in a huge crisis, so Im struggling with money and I can´t provide for both of us.

We see everywhere people just in the mood to go to America... And not so in the mood to be with their partners... Unfortunately...

But if no matter what you want your partner... Start ASAP a K1 or get married and start de CR1.

Being honest with US immigration is a mistake? Is lying a better option?

I dont care what was said, if you answered all the questions on your application to get a visa, then once you reach US soil you should not have to give your life history. Everybody that comes and stays a long time or everybody that applies for a visitor visa dont always do wrong. There are some honest people in the world. They need to come up with a better system other than going on what may look suspicious...........if she got approved for a visa, then let her thru

The system doesn't work the way you want it to. A visitor visa allows a person to know at the door, it does not and has never guarantee entry. It's call a double check. Some people who get visitor visas show up at the door with all their possessions ready to immigrate.

If you invited someone to visit and they show up with a moving van, would you let that person in?

Sorry, can't. Circumstances change.. and CBP officers are the doormen when the embassy interview is a distant memory.

Say a young student applicant puts down "sightseeing for two weeks" on the ds160.. then gets a 10-yr visa. Two years later.. when no longer a student, and say unemployed.. he\she may have other intentions for entering on their B2. That's where I want the CBP doing their job!

I work with (not for ) CBP also, people forget they are humans too. Daily problems, home, wife, husband, kids, bill, not enough of a paycheck to meet

Do tell and what about the people who lied at the interview? I think the entry process is very fair. The changes to the VWP were much needed. It is a broken system but not because of the questions they ask. The CBP officer knows the answers, he has the papers in front of him. You don't think people lied and forgot what they lied about at the interview? You know how many people are not honest. If people don't like the system or like answering questions there is no need to come here. It is no different than any other country. In Morocco, they ask a bunch of questions as well. No country wants overstayers in their country. The list of illegal things people do is endless. A visa does not promise a person entry into the USA. Why should we be different than any other country? The point here is don't lie and don't try and pull one over on immigration at any level. It doesn't work. They all have heard everything. They don't care...they have a job to do and protecting the country at the borders is their job.

I stated before I wouldn't want their job. In fact I wouldn't want any law enforcement job. They have a job to do and well being lied to normally doesn't go over well.
