Hello, I was wondering about how the timing of applying for a social security card and the wedding matters? I know you are supposed to wait two weeks after the date of entry to apply for social security, but then can we get married any time after that? Before that? Or do we have to wait to actually receive the social security card?

You actually do not need to wait to obtain a SSN. Once arrived, check out the I-94 and see if you're in there. Some people go immediately and some people choose to wait a little bit. You can get an SSN anytime before or after you marry, but it must be before the I-94 is close to expiring. Make sure you follow the guide in taking whatever documents are needed. If you run into an SSA employee that hasn't a clue, ask for a supervisor.

You do not need an SSN to get married. While many state's clerk of court marriage info websites mention the SSN, you can typically call the clerk of whatever court you are obtaining a license from, and confirm that the immigrant can use something else in lieu of an SSN. If a clerk of court employee refuses or doesn't understand, then find one that does. It's their loss of business.

Nope, wedding and SSN are separate business.

You need to marry within 90 days of arrival.

You could apply for the SSN the day after arrival. Don't wait to long with applying, they like to see that your I94 is valid for at least 2 weeks after the date of filing. If you miss this "deadline", you might have to wait for your EAD to apply for the SSN.

If it isn't difficult, it isn't worth it.

We chose to get her Social Security card the 2nd day she was here, reason being I could add her to my checking and savings account once she recieved her card. As far as waiting for 2 weeks to apply as soon as you can get your I-94 printed your good to go. If you marry first you will have to wait until you file your AOS and recieve your AP/EAD. Hindsight looking back I'm glad we went this route because I was a able to add her to my credit cards also. Just keep in mind for ROC you will need to show co mingling the earlier the better. Good luck

If you marry first you will have to wait until you file your AOS and recieve your AP/EAD.

As Harpa stated, this is not correct. You can apply for the SSN based on the K-1 entry as long as there is at least 2 weeks remaining before your I-94 expires. It does not matter whether you are married or not. Marrying does not invalidate your K-1 visa entry. If your I-94 is no longer valid, then yes, you need to wait for the EAD or green card.

That's not true.

This seems to be true depending on where you file.We were also told by our local SS Office that as I was trying to apply for my SSN after marriage that I needed to wait for my AOS, I tried to argue this with the supervisor but it fell on deaf ears, she mentioned had I not produced my marriage cert I could of received the card in my maiden name so that's what we did a few days later.

Yes, some SSA workers have no clue. You are supposed to be able to get the SSN in your married name if you produce your marriage certificate, and some are able to. However, it is advised that you apply in the maiden name that matches the name on your K-1 visa, whether you are married or not because of what you experienced. People get told all kinds of ridiculous things when trying to get their SSN, such as if you marry, then you are now a K-3, which is absurd and very wrong.
