Denied F1 to CR-1

Timeline

Hi everybody !!!

I am posting this for a friend of mine , it is a particular situation,i did not find enough information in the forum about it, may be someone can shed some light on this.

My friend is 23 years old from Morocco , he applied for student visa (F1) 2 weeks ago and got denied under (214) (b) if iam not mistaken, he works in a hotel as a waiter and recently he met a USC woman where he works and fell in love with each other and they are already planing getting married and apply for CR-1 after a possible second or third visit, she is 20 years older than him , his quistiones are :

1- would F1 denial affect CR-1 knowing the time difference between the two events?

2- will the age gap be a problem?

3- i forgot to mention he has a sister in the US , would that be a negative point for him?

4- what other red flags may get raised applying for CR-1 after F1 denail?

Day 376 (1/14/19) Interview

Day 385 (1/23/19) Denied

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX

It won't be impossible but it will be very, very tough.

It will look like he's determined to get to the USA by whatever means. Then may assume that his sister investigated sponsoring him for a family-based visa, found out it would take 15 years so now he is going through the list of visa categories and trying them all for size until he gets one.

I remember reading a thread about two years ago I think where someone said "I have a brother who has become a US citizen through marriage. How long will it take for me to be able to live there?" When told that it would be around 12 years or more he was noticeably disappointed and disappeared. He was back six months later, married to a USC and asking about a CR-1.

OP, tell your friend to expect scrutiny.

Interesting story. Without actually meeting them in person or knowing much about them sometimes you can tell by the tone of their post that they determination to get to the US by any means.

It won't be impossible but it will be very, very tough.

It will look like he's determined to get to the USA by whatever means. Then may assume that his sister investigated sponsoring him for a family-based visa, found out it would take 15 years so now he is going through the list of visa categories and trying them all for size until he gets one.

I remember reading a thread about two years ago I think where someone said "I have a brother who has become a US citizen through marriage. How long will it take for me to be able to live there?" When told that it would be around 12 years or more he was noticeably disappointed and disappeared. He was back six months later, married to a USC and asking about a CR-1.

His sister is LPR through marriage and was asked about her at the F1 interview,as said it is a tough situation and will need to proove he is not just trying to get the US.

And that's what any immigration officer will think too or that he already knew that woman before applying for F1, but as i know him i dont think hes trying to just get here ( not bz hes my friend) but he is a good english university student , he just got his TOFEl from a private American school in his city and working hard part time job to pay for his expenses , i think there are many factors making his case looks more suspicious than others : his sister, time between F1 denail and meeting someone that quick.

Do you guys thinks it w'd be a good idea if she makes more visits to him that way they will have enough proofs ?

Any insight will be appreciated .

What does he see in a woman old enough to be his mother? Is he okay with never experiencing fatherhood?

I remember when i used to watch 90 days fiance visa on TLC seen a couple with a very huge age difference , she was 18 Filipino and he was 50 somthing and he even had a daughter at her age ...so he is not going to be the first one to fell in love with someone older than him, sometimes you dont choose who! And where at! Love is beautiful.

That couple may not have had as many red flags as this situation.

There's nothing wrong with wanting to move to the USA. That's why we are all here. It's the reasons for doing so and how he plans to achieve that. I'm going because my husband is from there and has a lifetime ban from the UK. If I had married a Japanese man I would be trying to move to Japan. The place isn't why I'm going. If I had to live in a tent in the desert with my husband, then I would. It's the man I want, not the passport.

It's different with a younger woman and an older man. Men can continue to father children into pension age. Women can't. Also, in Asia it is more culturally acceptable for younger women to marry older men. In North Africa is it culturally acceptable for men of 23 to marry women in their 40s? I know it happens. But is it seen as unusual? I'm 42 and work with men of 23. We have nothing in common. They have a lot of living and learning still to do. I don't want to go through all that again.

Wow, there's just so many red flags. Expect a lot of scrutiny.

Apparently yes ...they are so in love with each other and as i mentioned already they are planning to meet again sometimes the end of this year so that they get to know each other more, iam happy to see him smiling again and enjoying each other company, i have read about similar situations in here and always love wins at the end despite of all the hindrances.
