My husband and I got married last weekend. We went through the K-1 visa process for him to come to the USA and we are now filling out paperwork for Adjustment of Status. I am working on filling out form i-864 affidavit of support for his permanent residence and am wondering when it asks my "LAST NAME (FAMILY NAME)" do I use my maiden name or his last name, since we are married now and I will be getting my name changed to his last name. Hopefully someone will know :) thanks!

you should put the name which appears on your goverment issued docs unless they ask you for your maiden name.

if you want to change your name, then first do that, so that the copies of your documents will reflect your married name, not your maiden name.

6/10/2016 - got biometrics letter in the mail, notice date is June 4, 2016, which 8/1/2016 - received answer for the service request "your case is under review" [Day 89]

is day 30 from when they picked up the package [Day 36] 8/2/2016 - case status of I-765 is "The Card was Mailed to you" [Day 90]

6/21/2016 - Biometrics walk-in in Philadelphia [Day 47] 8/4/2016 - received I-797 Notice of Action for approved I-765 [Day 92]

6/22/2016 - Scheduled Biometrics Appointment [Day 48] 8/5/2016 - EAD in mail [Day 93]

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You can put your married name even if you have not yet officially changed it. That is what I did on my own forms even though at the time I sent them my name was not officially changed. Just go to the nearest SS office ASAP to update your name.

They do not need to change anything first. They can start using their married name as soon as they are married.

OP, use your married name if you are changing it through marriage. The copy of your marriage certificate is your legal name change document that will be included with the I-485.

Ok, now I have a question

I thought first I had to change and on the documents so when i applied I put my maiden name everywhere, cause I couldn't change my she on my Ssn and everywhere else

So does it mean I will only be able to change my name to married through court or when I apply for citizenship?

I mean will there be a possibility to change name so that appears on the green card?

If you have an interview, you can ask that your green card have your married name. If not, then you will have to file an I-90 and pay the form fee to have the name changed, or wait for ROC or naturalization.

And if you would have applied for AOS and the EAD/AP in your married name, then you could have had govt ID in your married name with the EAD/AP. You could also have changed your name on the SSN with the EAD in married name.
