Can someone please help me!!!!! My husband admitted to drug use during medical interview in ciudad Juarez and he got his visa denied during his consular interview. He got a one year ban and was asked to file a I601 waiver for this. The question is why would he do this when his I601A had already been approved when he was in the states?

My husband received the 1 year ban as well but he has never been in the US so we didn't have to do any waivers but I looked for other cases similar to find out what happens and someone told me that because they admitted to drug use the waiver is automatically denied and they have to re apply for it and wait. One person told me she wasn't aware of it so even though her husband did the medical after the year ban they are now waiting because of the waiver, so it added time to their case. I'm don't know much about waivers but if you can do it ahead of time and save you more time apart then do it right away.

601a does not cover drugs.

Thank you so much!!! I honestly don't know if we can apply for the waiver now or wait until the year ban is over.. Has anyone else had this happen? Or who can I contact to find out. I pray to God we can start now since the waiver does take 6-8 months to process plus the paperwork afterwards for the visa. Thanks in advance.
