Well, if they ask and I haven't used for over a month it is not really possible to detect, or even suspect really...

It seems like it would be foolish to say I did and then get banned... :/

Unfortunately USCIS doesn't care if you 'no longer' use marijuana. They care if you have ever used it at all. This is a bit of an unfair system as I'm sure MANY people have done what you are asking (lied to the officials and gotten their visa no problem) but this puts them in a sticky situation since they are doing something illegal to enter the country. This can end up in having all of your rights revoked at any time. As I understand it, USCIS reserves the right to revoke your status at any time (even decades after the visa is issued) if they find you have committed fraud to enter the country.

This poster told the truth and her application was approved in pretty standard time. My advice is to tell the truth. If you are a current user then you are not applicable for the visa. If you have used in the past, but no longer use then you may still have a chance of getting the visa (as seen in this post alone). Just do not lie and say 'oh I never use, my system is clean' as this is fraud.

  • On Oct 13th AOS status was updated to say that a notice was returned due to post office being unable to deliver it. Tier two told me that it was biometrics or NOA1 (even though I had received both before this date).

  • A few weeks later I received a notice dated Nov 10th, in regards to my call about the Oct 13th notice. The new notice said that there were no RFE's or withholding on my case. So still not sure what this Oct 13th notice was about.

  • Received a letter from a NY office on Dec 23rd (dated Dec 10) stating that my medical was over 1 year old. (At this point my medical was only 7 months old)

  • Teir two submitted an internal service request to which I got a response telling me that I need to respond to RFE ASAP

  • Submitted another service request on 1/6/17. To which I got a response on 1/19/17 stating that my case was pending and is outside of processing time (no mention of RFE)

So can anyone clarify, should you or should you not admit to using marijuana?

Assuming that you indeed use it of course, and that you are able to stop using 1 month in advance to "clean" your system.

It seems that admitting to any use is a problem (even if just once in the past or anything).

I would love some clarification on this.

You shouldn't lie.

But for what it's worth, the doctor that did my medical exam in Toronto, Ontario phrased the question as 'have you ever had any PROBLEMS with drugs or alcohol.' There's a world of difference there.
