They will go by federal law on this, and not individual state laws. It was the same for immigration eligibility for same-sex couples. It may have been legal in a few states before, but while it was still not legal on the federal level, same-sex immigration was a no go.

The CO will make the decision though. Some have admitted to using marijuana and not gotten the year ban, but many others have. The OP can try and remain positive until the CO makes the decision at the interview. Hope for the best, but plan for the worst too.

Which of course there is, which my theory fits. So the ray of sunshine is hopefully you get cool psych and cool interviewer.

And you are in California which is very 420 friendly. That might go into play a little.

Yeah, I'm hoping this will help. He literally did not know how big of a deal it is because of all the media coverage on the legalization and medical benefits. When I lived in Argentina everyone asked me about the marihuana in California. I hope that if tells the interviewer the truth, that he didn't realize how illegal it was because of the confusion of legality at state vs feds, maybe they will understand... but these are all just hopes and obviously we can't know. I'm trying to be positive.

Doesnt matter what explains at his interview, he is violation of federal law, and it is an automatic ban. be thankful the ban is one year, it used to be three. Pregnancy is not a valid reason for expedite.

Its not always an auto ban.

Sledge I sure hope you are right! My fiance is confident and I am not sure if I should be annoyed at his over-confidence or think positive thoughts with him. Overall the Argentine embassy has a decent reputation, besides everything taking forever. And in general they have a pretty lax view on Marijuana, Its even legal across the way in Uruguay... All we can do is hope for compassion.

No interview yet, not even scheduled although we have been requesting an expedite for the pregnancy. He had the medical today and has the psych evaluation for Tuesday. Thanks for the responses. I'm hoping for some compassion and I have no idea if they are even able to be compassionate or if they have to just follow the books. All we can do is wait and try to be positive. It's not easy.

visas are not expedited for pregnancy and impending births

I have, but it was not habitual usage.

Pink wasn't being rude, it was a realistic answer. Wouldn't it be best if you faced the reality of the situation and understand what could potentially happen, rather than acting like it won't happen? I'd rather be prepared for the worst and hope for the best. No one can tell you your husband won't get a one year ban when that is what most likely will happen. I have never seen a case here when someone admitted to drug use and didn't get a ban. Immigration is not all rainbows and puppy dogs with or without drug use. I wish HFM would chime in, he is a retired CO and he could give you more insight into what happens in your husband's situation.

I agree, isn't it better to be prepared for the worst and grateful if everything goes better than expected, instead of getting your hopes up and possibly having them smashed at the interview?

I have gone through the EXACT same situation. The psych visit is to determine dependency and class of addiction.

OP no one (especially Pinkrlion one of the VJers who helped me so much through my ordeal. I think at one point in my hysteria you told me to just breath Pinkrlion lol <3) is being rude or negative. It's the facts. All that mess about California and Colorado and 420 does not matter one bit. Immigration is federal. AGAIN, immigration is federal and marijuana has not been legalized federally in the USA.

Look at my timeline. My fiancé's case showed denied on the ceac tracker before he even arrived at his interview.

I am compassionate. I've been there. I get it. I just don't believe is giving false hope and not being prepared for the possibility of what could really happen. I'll be praying for you. Good Luck.

The op clearly said in her first post that she understands the negative and she is prepared for it and she's posted it again.. Y'all seriously need to learn how to read. She didn't say "guys im completely unaware of what can happen please feed me negativity."

People read threads without adding a comment for a multitude of reasons:

Just browsing.

Interesting topic.

Just gaining insight.

Don't know the answer.

Have no experience with the situation.

Had a similar situation and want to see the responses.

When I first joined VJ I read all kinds of threads and still do and don't comment many times for one of the various reasons listed above.

I am looking for support and some positivity when all I see is darkness. If you re-read my post, you'll see that I'm already aware of the negative that you said, so I feel like your tone is pretty rude and your comment is simply repeating what I already stated that I know..

I forgot to eat for 9 hours and can't stop googling worst-case-scenarios. Obviously my fiance messed up, but not in any way that would actually matter if we weren't stuck doing this ridiculous process. Some human compassion would be appreciated, and if all you have is negativity to add, please be aware of your potential impact on a very stressed out pregnant lady and choose to remain silent.

We are all free to report any posts that we find overly rude or offensive. But also posters are free to express how they feel most of the time. It's best with immigration to develop a thick skin. I had to discover this pregnant as well.

I hope you can be reunited with your fiance soon and that you guys end up being lucky. However, I think your fiance might want to prepare for plan b and make it up to you, maybe work on a way for you to visit/stay in Argentina after your baby is born so you can still be all together - hopefully he won't need to, but he'd be ready to make it better to his family. Him working and supporting his new family and the three of you bonding instead of being separated.
