That is pretty much how it is. I am not forcing her. She is leaving on her own will at the same time I am asking her to leave. For my own sake, I need to confirmed she is on the plane. I may pull out my cell phone and record the event. If she does not get on the plane, that would be her problem to figure a way to stay. I have nothing binding with her. Except her cell phone, which I will take back by tomorrow. I am monitoring her calls too, she is not using any chat apps, so far nothing suspicious.

I understand why you would want to make sure she's gone, if just to know her shadow will never cross you path again. I don't think you'll have too much of a problem seeing her off. My wife had the same home sickness and culture shock when she got here. No sounds, no nosy neighbor heads just popping into the window and saying hi, what are you eating, no people all over as soon as you step out of your door. American life is very isolating compared to life in many Asian countries. As long as she has no support structure to help her stay, she most likely will just fly home. And you certainly have no intent to be her support structure after finding out about the cheating.

I personally wouldnt wait to see her get on or not either way nothing she can do no adjusting no nothing to bad so sad for her...and shame on her poor OP cambodia is ways away this man wasted a small fortune on that ungrateful woman. But he should mail uscis close the case. So if he so chooses he can refile even if he need a waiver no wrong doing in his part.. The mans a saint driving her 3 hours :shocked:

There is no case he can close. The only case he had was the I-129F petition, which is already expired when she entered the country. He could file another one today if there was someone else he met in person within the last 2 years. Heck he could have even filed another before she ever arrived in the country.

Thanks, culture shock would be the perfect term why she wants to go back, and on top on me not supporting her anymore. She does not know anyone here, which is a good thing.

I thought about sending a letter of explanation to close my case, but USCIS are the slowest and unresponsive people to deal with. Most of you guys mentioned the case will close itself, that confirmed my thought exactly.

I am only willing to do the 3 hours drive because I have no choice. When you want something done, do it yourself. My mother will be going along too.

Sorry, realized too late I quoted the wrong post by N and J. I meant to reference the one telling the OP to make sure she gets on the plane.

OP, don't listen to this person. In NO way is it your responsibility to ensure she gets on the plane, nor do you have any legal means to "MAKE" her do so anyway. You are not ICE.

At this point she is more or less here on a visitor visa and is LEGALLY allowed to stay for 90 days from the day she arrived. If she wants to leave now, great. If she decides to leave at 89 days, that's her decision. If it makes you feel better, drop her off at the airport, help her with her bags and watch her go through security and then drive away. If she suddenly changes her mind, and tells you she's not leaving and going to live here forever as an undocumented immigrant, you still drive away. It's not your problem no matter what happens.

He asked about if it would cause problems later if he tried to file for someone else and if she does not get on the plane to leave YES IT CAN CAUSE PROBLEMS FOR HIM. Oh wait I know that because I am in the process of trying to file a K1. In addition, I NEVER SAID IT WAS HIS RESPONSIBILITY. BUT IT CAUSES LESS OF A HEADACHE DOWN THE ROAD. Oh and just so you know since you think you know EVERYTHING according to the Immigration officer in Newark when I went for my Infopass appt. when he was finally out of status. A person is not legally financially responsible but depending on how one reports the situation with a person who overstays on a visa....You can be held responsible if something goes wrong. IF he takes the right steps and sends a letter saying he is canceling his K1 visa application, it goes in the file and released him from any problems down the road. So DO NOT TELL SOMEONE NOT TO LISTEN TO ME I have been here. Would you like me to send you the 200+ pages of documents I have proving he committed fraud so it didn't come back that I helped him??

We shouldn't listen to people who don't have the experience and think they are immigration lawyers. (eye roll)

So sorry to hear about your problems and I totally understand why you want to see her off. I think it's the responsible thing to do. It's not your "official" responsibility but we all have a civic duty and I think you are handling a sad and bad situation the best way possible. I'm sure for you, seeing her off will also help with closure. Good luck in the future.

Wow. Sorry about that. Unfortunately many do use the visa to come here illegally and are not honest about many things. My understanding as well after working with an immigration attorney on the K1 is that nothing is binding at this time before marriage. You have asked the government permission for her to come and to marry her. Either of you could end it for any reason. I was advised that after marriage there are more legal implications. Probably doesn't make you feel any better now but I'm sure most would agree that is something better to find out sooner rather than later.

OP, my suggestion used to be the case and might not be now, but it might be worth a try. If you're unable to confirm with your own eyes that she's boarded the plane, you might try phoning the airline, providing her confirmation number, and asking if she made it onto the plane OK.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So sorry this has happened to you; you think you know someone after 4 years....

Going to the gate with her and watching the plane take off for your own peace of mind I truly understand; it's almost like a type of 'closure' for you. I'd probably do it too. I think it's kind of you to take her to the airport, even though that's going to be a stressful 3 hours.

You can check a flight tracker site, like this: http://www.flightstats.com/go/FlightStatus/flightStatusByRoute.do to see if her plane has made it to Cambodia.

There have been K-1 cases denied at the U.S. Embassy Manila because the petitioner never closed a previous K-1 case. I don't know whether this would apply to any other embassies. I would suggest that you play it safe and notify the USCIS of your circumstances. Someday you may want to file another petition.

The K-1 case is closed when the visa is used. The denial cases come because no visa was issued and the case is still being held open at the embassy.

Here is a K-1 case at the U.S. Embassy Manila in which the old visa was never issued, and the current visa was initially denied but eventually approved.
