I am a US citizen and my fiance is in the Philippines. The USCIS received our case on March 28th and we are now waiting for the approval. I have a question about tax return requirements. I have not filed yet this year and I know I will owe some money this year because I accidentally exempted myself last year when I made some changes on my forms (We have online access to it). Last year I had a small return. A little over $100 which is why I made some changes and made the mistake. As far as income requirements, I meet those for my state, NY. 19,000 and I make 30,000. My question is, could I present my last years return or does it specifically have to be this years? We are hoping for approval by Sept and I want to make sure that everything goes well when it comes to the tax return. Will they look down on small returns or owing taxes? I definitely make enough to support her. I just messed up the last two years of returns because I'm new to NY state and its different than my home state of Missouri.

They will not issue a visa to her if you are delinquent on paying your taxes. If you have a payment schedule set up and are keeping on time with it, you should be alright though. They will not issue a visa to her if you are delinquent on paying your taxes. If you have a payment schedule set up and are keeping on time with it, you should be alright though. And yes they will want your 2015 tax statement. Its after April 15th, and they are already asking for 2015 returns in interviews.

Thanks for the quick reply. I'm about to get around to filing finally. I have an idea of how much it is and hoping to get it taken care of pretty quickly without payments. It sucks to expect a big return only to realize that nothing was taken out for the entire year!!! Which led to doing major overtime at work to come up with the money to fix it lol.

You should have filed on time and set up a payment plan even if you didn't have the money. There's still a penalty, but if you're not in communication with them, they will increase that penalty in time. I learned that the hard way one year.

You need to fix your tax issue asap to avoid jeopardizing his or her chances. The only deal with present situation not how much you were making 10, 5, 2 years ago. You will need an explanation as to why you can't provide current tax return and so far it's not looking good with your excuse. Good luck.
