Hi all! Quick question about filing the AP after the AOS paperwork.

My Husband applied for AOS of his K-1 Visa in Feb 16. We didn't initially file for AP with the AOS& EAD as we hoped things would go smoothly and he would be approved before his New year in September ( he's ethiopian).

HE has had his Biometric appt and has received his EAD, but we recently received an RFE for evidence of cohabitation and commingling of finances, which

seems to be uncommon for K-1 AOS and for the infamous I-693 which he went and got another medical exam.

We returned the RFE in 10 days or so and is with the IO now.

I saw in other posts that as long as the AOS is in process applying for the AP is still free... Should we just wait until the Interview/ GC or apply for AP now? HE soooooo home sick, and never been to the western world until now... Would it raise eyebrows since there is still more information requested for establishing a bonafide marriage?

Suggestions?

You can apply for AP now. Include a copy of the NOA1 from the I-495 so it is free. That's all. Good luck.

It will be a paper AP instead of being attached to his EAD, but it will be equally as valid.

Sounds like you received one of the RFEs that have been coming from USCIS offices such as San Fransisco and Tampa, even though they are not your local office. You will most likely be approved without an interview.

Thanks everyone!!!!

We will definitely apply for the AP.

KayDeeCee: the RFE was from palm springs which is not our local office... it would be Amazing if our case was one of those no interview ones !!!

I am soo happy I found this site it has saved us so much time and really has made a very difficult process so much more transparent. I have followed all the guides to a T from i-129 to now and I get to be with the love of my life.
