I am unclear if it was mentioned when he immigrated that he had a child?

The mother-in-law will have to decide where her priorities lie. A child that has been placed in her care or her parents, grown adults. I know where mine would lie.

Is there no one who can care for the parents in Canada? I don't know what care they need from her? Is the mother-in-law a doctor or nurse? There are plenty of healthcare workers in Canada who can do a fantastic job of caring for them. The child, on the other hand, apparently has no one else.

We're not talking about going to take care of parents because they're old here. They're DYING. You don't abandon the people who gave birth to, and raised you. You figure out a plan to make it work so you can go.

Are there any other relatives, friends neighbors that can take care of the children? If they're dying I imagine it wouldn't be a need for childcare for too long?

OP could you fly to Jamaica and take care of the child in the interim, until the MIL can return? You could file in the meantime for the child and not waste time.

he was not included

Did he forget he had a son or? Look we make our cases tough by ourselves. All he had to do is list the son on the CR1 forms and can later bring him or decide not to bring him at all. This would have make your request easier by now. Now he's put himself in a hot water. Sorry but we have to put everything on paper at the initial stages. Hope you find a way to bring him.

I totally get that and if my parents were both dying at the same time I'd try my best to be there (although my parents don't even live in same country as each other and hate each other so it'd be even more difficult but...). But there is a child here that NEEDS her more. And presumably she has a legal obligation to be there for the child. It's looking like she can only be there for one or the other - and the sensible thing would be to stay with the child even if it's not the right thing to do emotionally for the parents. Somethings going to have to give.

Maybe it's because of my faith that I don't see death as a 'goodbye' or the end.

This an immediate urgent situation.

So anything involving the US is out, and there seem some other issues.

So we are left with an either or situation.

Child goes with her to Canada.

Child stays and is looked after by someone else.

Not rocket science.

Curious about the visa that the family member is going to Canada on.

Sort of assumed it was a visitor visa, that is all the child would need.
