Filing of form i-765, trying to save time and money.

My fiance just arrived in the country. Will I save money, the $385 fee, if I wait until after we are married? I am not sure because of this statement from the instructions:

"If you filed Form I-485, Application to Register Permanent Residence or Adjust Status, as of July 30, 2007, and you paid the Form I-485 filing fee, no fee is required to also file a request for employment authorization on Form I-765."

does as of July 30, 2007, mean if I am filing after this date or before? So if I file the Form I-485 and Form I-765 concurrently will I only have to pay the $985 fee or will I still have to pay both? Trying to decide, because he wants to start work ASAP.

This process is so confusing and expensive, filing fees for paperwork seem outrageous and never-ending :(

Thanks for any help.

EAD is free when applied for with AOS. The EAd available before marriage is basically useless. Read the guides.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

You have to be married to file for AOS. You can file for EAD/AP along with that for free. AOS fee is $1,070.

It's important to look ahead to know what your in for. Getting the K1 was just a first step, then comes, AOS and ROC.

Filing for the EAD before AOS is a pointless waste of $380. It will expire when the I-94 does and takes almost as long as the I-94 is valid to receive after filing.

Print out your I-94 info > https://i94.cbp.dhs.gov/I94/request.html

Follow this guide for getting the SSN > http://www.visajourney.com/content/ssn

Follow this guide for AOS > http://www.visajourney.com/content/k1k3aos

The fees are listed here > http://www.uscis.gov/i-485

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

Oh, and here are the details you need about whether or not you need to see a civil surgeon > http://www.visajourney.com/forums/topic/551080-immunizations-ds-3025-or-i-693/

Thank you, very helpful. One more question. Does it matter which state we get married in, Florida, where we live or can we go to Delaware, where my parents live. Thanks

Of little consequence as far as USCIS is concerned.

So we got married on 5/17 and we are preparing the AOS, etc. Which eligibility category do we choose, (a)(6)?

Also on the advanced parole request it asks for specific dates and reasons for travel, do you have to fill this out? I thought it was only for if an emergency and travel is required. If no travel is planned do we need to submit this form?

:guides: easily accessible at the top of the forum page. In particular, the K1 Tip Sheet: http://www.visajourney.com/content/k1aos

There numerous similar-themed threads with your AP questions in the AOS forum, review some. Be sure to use the Example Forms, also easily accessible at the top of the forum page, for help on filling out the AP application, it is a piece of cake.

Good luck on your immigration journey.

(c )(9 ) - adjustment applicant

No explanation or reason is needed when filing the I-131 with a pending I-485 as an adjustment applicant.

At the bottom of page of 2 it states this : If you are applying for a non-DACA related Advance Parole Document, skip to Part 7

An adjustment applicant does not fill out Part 4 stating a reason and purpose of their travels, and you do not need to supply the extra statement.

Leave date and length blank, then hand-write Unknown for those after printing out the form, OR enter N/A for those, since you have no current travel plans.
