Hey everyone,

Those few months sure did fly by! My Green Card expires on July 16th and due to some personal issues, I'm about 2 weeks behind sending off my ROC package. I know it can be sent within the 90 day window but I was originally planning to send it off the first day I could. Anyway...

The ROC package seems fairly simple compared to the AOS package, mainly just a collection of evidence.

Does the evidence have to be the evidence you sent before AND new evidence? Or does the USCIS just want to see how your relationship has grown since getting approved for your GC?

I kept everything from my AOS interview/package but we have a lot more new evidence to send in so I didn't know if it's redundant to send in old evidence too when they've seen it before/probably have it on file?

I'll probably have a few more questions in the coming week, I'm planning to send it off next week at the latest.

Thanks!

They want all document from past, present and future

Okay so re-submit everything AND submit everything since?

I was reading to provide as many bank statements, credit card statements etc to show consistency as well.

We also have joint utility bills however one of us is the primary on each so when we actually get them in the mail, they are only addressed to one of us, so they are mailing me an address verification letter with both of our names on it. So should I include the bills?

They want everything from the date of your marriage.

Some evidence may overlap..

I did not include any bills as they are all in my name. The companies will not put two names on the accounts. I stated that in my cover letter though.

Gotcha.

I just contacted both my utility places (one for water, one for electricity) and they are both mailing me out a letter that has our names on it under the account etc so I will just submit that.

Since many utilities will only put a bill in one person's name, some bills in one name and other bills at the same address but in the other spouse's name serve the same purpose: showing your financial & social lives intermingled.

Also just saw this in the guide.

For the ROC, you'll have to send evidence from the inception of marriage to the time of filing. So there may be some overlap but not much. The "how you met" part doesn't matter anymore for ROC like it did for AOS. ROC is about "what have you done together since you got married". So things like joint assets, living together in the same place etc. matters. Good luck on your I-751!

Okie doke! Just wanted to be sure as I had read some threads with conflicting opinions. Thanks!

Hi Erica and Lily -

My husband and I sent our ROC back in Sept 2015 and got an RFE a few weeks ago for more proof of financial commingling. That sucked but obviously we hadn't sent them enough proof. We sent about 200 pages with our original packet and about 500 more pages with our RFE response. Below is a list of what we sent (original in green - response in red). Hopefully this is enough to get approved. We just sent the response yesterday, so only time will tell.

Obviously my advice is to send every page of every document going back to your wedding. This is especially true for bank and credit card statements, including transaction pages. Good luck and feel free to reach out directly if you have more detailed questions.

Sean

1. Copy of green card
2. Copy of our driver licenses
3. Copies of IRS account transcripts for joint filings 2013 and 2014

Sent 2013 & 2014 again plus 1040, W2, and other tax docs for 2015
4. Copy of joint auto loan paperwork

Sent again
5. Copy of joint vehicle registrations

Sent again
6. Copy of current joint car insurance policy

Sent copies of insurance cards going back to 2013 to 2016 plus a letter from the insurance company confirming both names on the account back to 2013
7. Summary pages and samples of transactions for joint bank accounts

Sent every page of every savings, checking, and credit card statement plus transaction pages going back to 2013 (these made up about 350 of the 500 additional pages we sent)
8. Samples of lease statements for our apartment (one per quarter)

Sent every monthly statement going back to 2013
9. Copies of joint Flexible Spending Account
10. Copies of joint memberships in wholesale club
11. Copies of itineraries and receipts for recent trips
12. Copies of photos from trips and with family and friends
13. Copies of cards and emails from family and friends

14. Mortgage paperwork adding my husband to the deed (made this change a couple of months after originally submitting ROC)

15. Health insurance info going back to 2013 (didn't originally include since it was part of the AOS packet but we added to RFE response)

16. Utility bill statements (didn't originally include since none of them would put accounts in both names, but we added to RFE response with an explanation plus which joint account these bills were paid out of)

17. Living wills and medical powers of attorney (didn't create these until after originally submitting ROC)

Hi Sean,

Thank you, that is very helpful!

Does it cost money (or a large amount) to get a living will and medical powers of attorney set up?

Sample living wills can be found online, but we paid for it via one of the online sites. It would run about $100 total for the two living wills if you did it yourself as we did. Just keep in mind that each state has different rules, so look up info based on where you live.

Needless to say but I'll say it anyway. Wills, living trusts and durable power of attorney are serious legal documents with potential and actual personal implications and tax and inheritance outcomes. At the very least you need to check your own state laws to determine what is needed. They're certainly not just something to beef up an immigration package not that I'm saying anyone is suggesting that but they're not like utility bills...
