Good morning

Help yesterday i had my interview for IR1 in London. The lady was very nice, when i arrived at the window to be interviewed i saw her holding a blue paper and the AOS documents. she asked me how i met my husband (USC).

she then told me that my visa application had been refused, because my husband's income and joint sponsor (my sister-in-law) did not meet the threshold for to sponsor me.

The lady gave me the blue paper and my passport. Is this normal in the UK.

I told my husband we are both devastated about this. He is going to ask other family members to be joint sponsors. On the paper it says we have 12mths. however given that the medical examination and police clearance expire in October, in order not to repeat these two process we need a sponsor urgently.

Any advice will be very much appreciated.

I'm sorry for your situation. There's not really anything to do but to find a sponsor that makes enough to help you out. You are aware of the 125 % threshold they need to meet? Do you (your husband) have any assets that could help as well as income?

If it isn't difficult, it isn't worth it.

Hi

I (UKC) do have a house with some equity in it. However I can't sell the house right now because i am living in it. the plan is to sell the house as soon as the visa is approved. My husband (USC) does not have any assets. He said he will talk to other family members about our situation i pray that they can help us.

Hi

yes we were aware of the 125% poverty line. . Our calculation based on a family size of three is around $30,000. AS my husband's income is less than $30,000 we combined my sister-in-laws income which brought the income upto $47,000..

The area that was seriously overlooked and error on our part is that my sister-in-law has dependants. which means that we should have used another joint sponsor.

You can't combine incomes. They have to earn 125% for you (just you) and their house hold. I'm so sorry to hear this, I hope you can find someone soon.

Are you sure your husband filled out the form properly? Does he live alone or does he have children who live with him? Are you bringin a child with you?

He plus you is only a household of 2. That's $20,025.

Add a child and it's $25,200.

How much does he fall short?

Your house equity can be listed as an asset. You need to document the value with an appraisal. You do not have to sell it first.

Hi

Thank you very much for the advice, the shortfall is $25,000. Even though my sister-in-law's income was sufficient because she has children we are not able to consider her as joint sponsor.

I have just contacted estate agents to do the valuation on the property.

Can you explain better?

How many people? Him, you, children? American citizen children? Or children getting a visa?

Does he earn any money? How much?

Next separate issue.

On the sister: Does she have a husband? How many children? Are you bringing a child that also needs a sponsor?

Hi

So your husband alone needs a job earning $25,200 for a household of three. You said above he is short of that by $25,000, so his income is only $200 per year.

My sister-in-law (USC) she is divorced she was the joint sponsor as four children (all USC) who are dependant on her. she lives with her four children. She also receive child support from the children's father, the payment was not included in her income calculation.

For your sister to sponsor, she has her family (5) plus you and your child (2), so $45,912 for seven people. She doesn't make that much. She can count child support as income if it is documented on paper, like a court order,

Hi

Thank you for you support and advice.

My husband's yearly income is $21,000 which is less than the required amount. Based on my own calculation because he is sponsoring me and my son thought in order to meet the 125% poverty line he would need a joint sponsor earning income earning around £30,000.

our calculations were completely wrong. we made the error of combining my husband's income with his sister's income. if we had calculated separately we would pursued another joint sponsor.

Maths was never my strong subject.

How are assets calculated ?

thank you again for your help.

Your husband needs at least $25,200 to qualify. His household count is three, him, you, child. See the chart right here https://www.uscis.gov/sites/default/files/files/form/i-864p.pdf in the 125% column for three people.

$25,200 (needed) minus $21,000 (what he makes) is $4,200 (how much he falls short).

You can qualify by showing additional assets of 3 times the shortfall. So 3x$4200=$12,600. If you can prove at least $12,600 equity in your house or savings, you have enough to make up that he is only $4200 below what is required.
