Hi all,

A long story. Hope you bear with me.

I just entered the country as a resident. I want my sister (44, mexico passport holder and married to Swiss citizen) and nephew (11, Mexico passport holder) to visit me.

I helped her fill out the DS160s.

Here is the thing...

Back in 2000, we went on a trip to Canada and since we didnt have US visas, we were flying as TWOV passengers, escorted in and out of planes. Later that year she applied for a tourist visa and was refused. She was young and had a high paying job, but was single.

CO refused her and only stated that it was not due to financial reasons, but that at the time it was not possible to issue a visa for her.

Now that we filled the application together she remembered that time she applied, and I told her that we DID enter the US previously, but as TWOV (Transit without visa) en route to Canada. I told her to disclose that in the application.

She had a moment of clarity and was like... D-oh! Maybe that is why I was refused back then.

I am freaking out because maybe that is indeed why she was denied back then.

The CO did not have an obligation to disclose the reason with her... So it is possible that is the reason... And if so, sigh. :( I know how serious that can be.

To be very honest I do not remember how the applications were in 2000... All I remember is that it was a very simple paper application. I applied in 2004 and it was still a simple paper thing you actually wrote down in. I do not remember it asking about previous US travel. So, I have a slight ray of hope that she is not slapped with a misrep... :(

But then... Naybe she made the mistake of not listing her entry in the past. I know this sounds naïve and terrible. She was not trying to conceal anything. It was an honest mistake or misunderstanding on her part. She did not seek the aide of a professional (myself, wink wink).

This time, on the question regarding if she ever was in the US, she put YES. Under explanation of previous visa refusals, I advised her to be explain that she had been in the US briefly as a TWOV passenger en route to Canada before, and that she does not remember very well the dates, but that this was also in 2000. I also advised her to explain that she applied later that year for the visa and was refused.

Do you think this is a good enough explanation and that her mistake (if any) can be salvaged?

I really hope she gets the visa, I would love her to see the sites here.

Any opinions deeply appreciated.

I find it hard to believe it had anything to do with the transit issue, much more likely normal reasons.

I just wanted to update... they went to the fingerprinting and photo today. All was good and went smooth.

They were out in less than ten minutes.

Interview is next Monday at the embassy in MX City.

Anyone reading this.. please say a prayer for them so they can visit me this summer and many many more summers after that! :luv:

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I just want to thank you all who replied to my questions and of course to those who kept us in yours prayers.

My sister and my nephew got their tourist visas approved today!!! I'm so happy!

CO did ask about the previous visa application, she asked a LOT of questions about my sister's relationship and the fact that her husband is Swiss. She wanted to know exactly what he did and where he worked. CO also asked about where my sister works and how long has she worked there (16 years).

All in all, a VERY stressful process... But well worth it! They can come knocking now and visit us in the US!
