Medical Hardship Question - Do I need counseling appts, too?

Sooo as a person looking at a different view, these are some questions to ponder that USCIS may look at in your waiver. How are you filing medical hardship, when you have been medically stable for over ten years? If you have had this condition for over 20 years, why are you now seeking mental health support? Are you in a support group, blog, or chat room for others with your condition?

A letter from your doctor is more than enough, and describe the treatment you have here. Your disease is genetic.I don't see the reason for therapy . I submitted several waivers stating physical diseases and/or GC genetic disease as well, and i never asked them to attend therapy. All waivers were approved.

You should submit proof of the health system in his home Country and how hard will be for you to get treatment/following up there.

Seems to me that going thru the process this way would not speed up anything

going to how many apppointments and getting documentation after would take time

the normal CR1 is a year

the waiver is not necessarily faster / it is just a waiver

A woman in Nashvile applied for a waiver after getting hurt seriously when a truck ran over her last year and she still waits to hear if her husband can come care for her

Thank you for your feedback. I am not medically stable, in reality. My medication helps me manage my disease, but even still, I do have symptoms pretty much every day. I was even fired from a job a few years ago, for having too many sick days.

The stress of dealing with the whole immigration thing has certainly not helped my mental state, but the reality is that I've been wondering if I'm starting to develop Depression / Anxiety for the last few years now, long before we ever started the immigration process for my husband.

I ended up doing 5 counseling sessions with a psychologist, she's been really helpful and easy to talk to, and I'm thinking about continuing to see her every few weeks (if I can afford it), even after the 5 appointments are over.

Thank you, that's a very good idea. I managed to find a press release in Spanish from the office of the Ombudsman for Human Rights in Guatemala, from November, stating that Guatemala's healthcare system is now in the worst condition it's ever been in. Very shocking and eye-opening report detailing just how bad it's gotten there. I'm including it as part of the evidence for my hardship letter (with the English translation done by a translator, of course).

Thanks, Adil & Jeanne, that's a good point. We are not requesting that they expedite our waiver because the lawyer explained that that is only used if the person has cancer, which I don't have (in fact, I've even heard of people with cancer who still are not granted the expedite, and have to wait the same amount of time as everyone else).
