My name is Annabel, my spouse has dual citizenship (Nigeria and US.) He is in the US whereas am in Nigeria. We are about to file IR1 visa but we are thinking about going for a tourist visa first so that I can visit while the IR1 visa is being processed.

I intend to use NIGERIA as my spouse nationality for the DS160 form for the tourist visa application, wheras when we will be filing for the IR1 we will use USA as his nationality.

This is not a lie, because like I said, my spouse has dual citizenship but I do not want to be refused a tourism visa because my spouse is a USC. I also do not intend to overstay.

Please tell me what you think. Thank you

Try to trick the US Embassy, then be prepared to pay the price.

You have to disclose if you have any relative in the US. So how does listing your husband as a Nigerian help when you have to disclose that he is in the US because he is a US citizen?

Your attempt at outsmarting the US Embassy is going to end badly for you. You are not going to outsmart the US Embassy.

Then, prepare to explain how your spouse all so suddenly changed nationality between the two applications. Don't think they don't store the information you provide. This will come back to bite you.

If it isn't difficult, it isn't worth it.

They already know your spouse is in the US. His immigration records exist in "the computer" and they will see your falsehood right up front, deny your visitors visa and give you a harder time at your interview especially if your husband used another USC wife to get his citizenship.

This will not be over quickly. You will not enjoy this.

Since you will have already answered "yes" to the question that asks about having immediate relatives in the USA, there is no way to avoid the issue. If the consulate doesn't already know everything about your spouse, they will ask you to clarify for them. One way or another, they will discover that he is a US citizen. When they do, it's probably better if you disclosed that fact willingly rather than have it appear you are trying to hide something.

His nationality is not what gets you denied you have a spouse that lives in Nigeria and you are trying to immigrate there so your ties aren't to Nigeria anymore but to US.

Using a Nigerian passport does what? You will already say you are going to see your husband right? Really immigration isn't that dub don't pay the system you will lose.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
