K1: Question on Income Requirements (Form 1040 not Meeting Poverty level Req't)

Hello. May I check if it is enough that the current income (proof based on my fiancé's letter from the employer) meets the poverty level (if annualized)? His 2015 Form 1040 (line 22) did not meet it though because he was working part time during the early part of the year and got employed in his current job around mid of 2015.

The CO will consider the current employer's letter stating current income and if it meets or exceeds the poverty levels there is an excellent chance you will past. The Philippines Embassy has not been asking for income information for awhile so it may not be an issue. I would bring supporting documents just the same as suggested in the Embassy Letter which I quote below:

1) 2016 Poverty Level's

2) EVIDENCE OF SUPPORT.

You should be able to demonstrate that you will not become a public charge

or burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form may be

useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You

may also be asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and

wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to

substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.
