I-94 taken by IO at AOS interview

your I-94 becomes invalid once you file an immigrant petition from within the US. asking someone for a copy and than the original is common sense.

Ah yes of course i understand now.

In my mind i was thinking if my case is fine my i-94 is taken because i wont need it anymore as i would have a grencard no reason for it.

But if my case could not be approved shouldnt i have been left with the i-94 as i will need it to proove my legal status as a F1 student

Valid I-94 does not solely prove legal status for someone on F1. Valid F1 and SEVIS does.

i am not an expert on this but I-20 is something you get from each school you get an admit from and SEVIS is a database that tracks a F1 holder. it has all the I20's listed to the schools you have been a student at while on the F1

Lovelynyc, I started out in the States on F-1 student visa as well although now I am on H1b. I-20 is simply a departure/arrival record. If you enter using F-1 visa then the I-20 expiration date would be stated as "d/s" duration of stay.

SEVIS record is a completely different matter. SEVIS record is maintained separately by your DSOs, in essence, people that work at the international center of your school. While you are on F-1 student visa your SEVIS record needs to be active all the time or you will be out of status. You should check with your school DSO to see if your SEVIS record was ever inactive.

Have you ever transferred schools? E.g. high school to college to grad school? Did you remember to transfer the SEVIS record as well? Did you ever engage in CPT? DId you ever fall below the minimum required course load while you are a student?

Hi, yes my SEVIS all paperwork in reference to school was always up to date. I was always extra careful because i know what happens when you dont stay up to date. So i dont believe it could be an i-20/ SEVIS issue. But hopefully i can get some answers from the infopass

Hi all I just wanted to give you an update on my case, it was finally re opened and then approved . I now have my Greencard! Thank you everyone who helped :-) and I wish everyone good luck and success on their applications :-)
