If your Conditional Green Card expired in August, your extension letter should be good until the 1 year anniversary date (ie: August). The USCIS person you spoke to had the wrong information about that.

Get a lawyer if you want, but it really won't do any good - there's nothing a lawyer can do to speed up the process - he/she will be glad to take your money, though.

Remember that you are never out of status while your case is in progress. The only time you are out of status would be if you were DENIED. If an employer checks with VerifyMe, they will see that your husband is still a conditional permanent resident, with his ROC petition pending.

The only thing you won't have once your extension letter expires is proof of your legal status, which I will admit, is important especially in this political climate, or of course if you want to travel outside the US.

So here's what you do: (and you don't need a lawyer)

  • Start calling to make an infopass appointment within the month before your letter expires (so - July). They won't be able to help you if you go in before that.
  • When you go in for your infopass, tell them your extension letter is expiring in August and you need an I-551 stamp in your passport.
  • That stamp acts as another 1 year extension, and is proof of your legal status either for another year, or until your ROC has been processed, whichever happens first
  • I know this is frustrating, but don't panicAnd don't waste your money on a lawyer you don't need. There's a delay. A lawyer can't fix it or help you jump the queue in any way.

Good luck, and stay calm! It's going to be all right!

Thank you

Hello,

I was hoping for assistance in the following matter. I did search through the forums and I'm not too familiar with the process so wasn't sure of some abbreviations and a couple of the other threads I noted didn't seem to have updates.

My wife was issued her GC on 5/5/14 and therefore was set to expire 5/29/16.

We filed Form I-751 May 5, 2016 and attended our appointment on July 19, 2016. We were told that the GC would take a few months.

We haven't received the updated card as of yet and when I called in, I was told that this is normal processing time. Issue is that the one year extension is due to expire in 2 months and we were planning on traveling overseas in June.

Is not receiving the GC 8 months after the appointment normal? What would be the best course of action in my situation?

Thank you very much in advance.

Unfortunately, right now it is pretty normal. Did you submit your I-751 to the California office or the Vermont office? It sounds like Vermont, if they told you that your case was still within normal processing times... Vermont is still working on applications from February and March 2016.

So assuming your wife still hasn't received her green card in April, make an infopass appointment at your local USCIS office. The appointment needs to be within 30 days of your current extension letter expiring. When you go in, bring her expired green card and soon-to-expire letter, and her passport, and you will get an I-551 stamp in her passport that gives her another year extension. That will allow you to travel overseas with proof of her LPR status. (the stamp in her passport is equivalent to the extension letter.)

Correct, Vermont. Will do in April (if not received by then). I would assume there is no fee involved?

Nope, no fee. It is sometimes difficult to find an available appointment time online, though, so do start looking for one in April (and some people say that the system resets at midnight so times become available at that time. I don't know that from my own experience, though, just from what I've heard.)

OK VJ Family------- RFE

I am May 4, I had called USCIS, I had received e-mails from USCIS with generic answer, and yesterday a received a RFE letter from, asking for a bunch of docs for my Good faith marriage, must of the paper they're asking we do have sent, with exception of loans together and credit card statement.

Is there any person here that has received a RFE, also here??

Eosorio, for my experience, it doesn't really matter if you sent the documents already. If the USCIS asks you for some documents, send them to them as quickly and as organized as possible. If they ask again, send it again. It sucks I know but the only other option for you (us) is to get denied your petition..

Good luck!
