It's depend on each case. Our case interview waived last time and ROC also no interview.

I have sent 3 notarized affidavits in my original ROC package. I am now going to get 1 notarized affidavit from my cousin sister.. I have since moved 2 times and moved to a different state. My only connection to the previous state was because of him. So i have not gone back again. It would be difficult to get more affidavits now. We dont know any priest and we were never really talked to any neighbours. They hardly ever come out and talk. 

 

I am going to send a cover letter, explaining my short story since i came to usa and till my husband pass away and give explanation as to why i dont have more evidences that they requested for. Plus i add 2015 tax document and 1 notarized affidavit. Plus i have some old letters sent to me at my husband's address when we were living together. Do i have to also mention why we didnot have any kids? Do you think this document is ok?

Looking for assistance with a RFE. Any help would be appreciated:

Notice Date is 5/18/17 and Deadline to reply is 8/13/17.

"You submitted: a bank statement, income tax documents, a health insurance card, an employment benefit document, identification documents, and a marriage certificate in support of your marital relationship.

The bank statement shows that you and your spouse share a common financial account; however, you have not established that this account is used by both you and your spouse to manage common financial resources. Specifically, it covers on a one month span of your marriage.

The joint income tax documents from 2015 do not indicate whether the tax returns were accepted by the Internal Revenue Service (IRS)."


How am I able to established that we both use the account? Would her own personal account with the same address help? The statement only spanned one month of our marriage because it was a monthly statement...ugh.

Funny, how they have no comments on all the remaining documents I submitted.

It's very frustrating that I have waited almost 13 months for this reply. On top of that, they are very clear in the RFE to let me know that "because many immigration benefits are time sensitive, you are encouraged to respond to this request as early as possible"

I made an InfoPass appointment two weeks ago and we were given a temporary card that extended the GC status for one year, as the passport was not available. Is it possible to be done with all this and apply for citizenship?

1 month statement is not even remotely enough. They want to see statements sparing since you were married or at most the moment you got your green card. These statements should spare for atleast 2 years. The bank statement needs to be a joint one with both your names and show transaction pages as well. If both your names don't appear on the statements, you can send a voided check ( check should be showing both of your names highlighting account number) attached with monthly statements.

 

As for your taxes a tax return transcript is the most accurate as it shows what the IRS has on record for you and it's so simple ( about 3 pages) for a given tax year. Go to IRS.gov and follow instructions to get free IRS tax transcripts for the last 3 years. These should suffice. Additionally tax return transcripts can also be ordered by phone as well and should arrive in less than a week.

 

You can't naturalize until you've successfully removed conditions. You can send N400 whenever your window opens. It will be processed however; it won't be approved until your I-751 is successfully adjudicated. This could be before the N400 interview or they might do a joint I-751 and N400 interview together. Send your RFE as soon as possible so you can move on with your life.

Thank you for the quick reply. I'll print out as many months as possible from the past two years. (It is a joint one with both our names). We don't use checks and don't have them on this account, so that's not an option.

Transaction pages on the monthly statements are vital as they can see it's an active shared account with money getting in and out for a while, and not just a last minute opened account to circumvent the immigration process by fraud. Since it's a joint one showing both of your names you're good! 

 

Now other forms of evidence include wills, medical power of attorney, joint lease, joint memberships ( Costco, gym, Sam's club), other joint financial liabilities like joint credit card statements ( even if you're an authorized user), 401K/ retirement account listing each other as beneficiary, joint bills ( electricity, water, sewage, garbage) joint insurance ( car, health, life). USCIS places emphasis highly on joint financial liabilities. You should be fine after supplying those statements, tax transcripts and any other that you can lay hands on.

Hi all you May filers. I'm preparing I-751 pack for June filing. Quick question.... my husband and I lived apart for the first year of our marriage due to him working in a new job in the USA and me having to stay in Uk because I was waiting for my green card. Do you think this will affect our case for removal of conditions. We have lots of evidence but some documents only start in joint names from when I arrived in the US not from date of marriage. Thanks all

No you should be able to successfully remove conditions provided you have lots of other evidence as well as you say you do. By the way this thread is for those who filed on May 2016. You should join June 2017 thread when it opens up or perhaps May 2017 if you file this month.
