NVC system shows husband as Citizen when he is a LPR. Now what?

I am the Principal Applicant in a visa petition for F2A category. I got an e-mail from NVC informing me that my Interview has been scheduled for 15 June 2016. I called them to confirm the date and told them that my PD i.e. 17 April 2015 is not current yet. The operator on the other end checked into the details and told us that my husband is listed as a US Citizen in their system which is a mistake because he is a Lawful Permanent Resident. In all the paperwork that has been done, we have clearly mentioned that he is a Lawful Permanent Resident. She further informed us to contact the Mumbai Embassy as they will let us know what to do further. After the interview date was sent to me via e-mail, I have been in constant touch with the NVC and the Mumbai Consulate. I even got an e-mail from the Mumbai Consulate stating that it is better to follow NVC's steps. I have already received the Interview Letter (P4) from the NVC.

Please advice us what to do next. This is very worrisome because in all the documents filed like I864 and accepted by the NVC, nowhere does it say that my husband is an US Citizen. Are they cancel my application now? I have checked all the paperwork that was sent to USCIS and the NVC but in all of them, we have written that he is a LPR only!

At the interview, you can show the consular officer that all of your documents say LPR and bring copies of the emails in which you talked with either NVC or the Mumbai consulate about it as proof that you've been trying to correct the mistake. Since none of your paperwork stated that he was a citizen, then it wasn't your fault and it's not misrepresentation. The consulate will see that it was USCIS/NVC's mistake.

10 Aug 2016 - Medical Exam

25 Aug 2016 - Interview - APPROVED

1 Sep 2016 - Husband picked up his visa

I think you should contact NVC again, ask for the supervisor and have them correct your application based on what the Embassy said. Even if you show up for the interview, it's highly unlikely that they will grant you a visa just because NVC made a mistake, they will possibly send your files back to NVC for correction. All the time and money you spend on medicals, travel will be a waste.

Thanks you arken and B&Z for replying. I just got an e-mail from the Mumbai Consulate saying that they will review my case and let me know further. I guess I'm just scared that they'll cancel my entire visa application with no fault on our part! :cry: I am so confused whether to start preparing for my interview or wait for what happens next!

Hey. I have an update.

I just got an e-mail from the Mumbai Embassy that they haven't received my file yet after I again e-mailed them twice because I wasn't getting a reply. So here's the thing, when I call NVC, they tell me to contact Mumbai Embassy but when I call Mumbai Embassy, they say to contact the NVC! What do I do?

I have at least sent both of them 15 e-mails regarding this issue but have received no proper response apart from that the NVC still sends the e-mail of my interview being fixed after I filled up the AskNVC form on their website multiple times.

What to do now?

I saw someone in the consulate that was being told off by the CO because she showed up for the interview when her waiver was not approved yet, just because her lawyer told her to show up.

They will not issue a visa if the date is not current, so I suggest you cancel the appointment if possible and reschedule once the date is current.

This should be done directly with the embassy if NVC already completed your case.

Hey everyone! My husband just got a call from the NVC a few hours ago! They said they read my multiple e-mails and corrected their mistake so now I don't have to go to the interview and spend money on the medicals! Yay! I had given up hope that they'll correct their mistake before my interview and thought that now I would have to spend so much money on travelling and everything for no reason. But fortunately, they corrected their mistake. Now I'll go when my PD is current. I have already e-mailed them about the call, just to be on the safe side.

Also, is it weird that I feel happy that my appointment got cancelled? I just didn't wanna waste all that money and time and energy for no reason at all, because the Embassy wasn't gonna give me a visa anyway before my PD was current.

It's weird because I want to say that's good news, but at the same time it's not?

At least you aren't wasting money going for the visa when you know you can't be granted the visa! :D
